The Challenge

The California Civil Rights Department (CRD) is responsible for enforcing laws that protect Californians from discrimination in employment, housing, and other areas of public life. While the Civil Rights Enforcement and Litigation Fund supports this important work, limited public reporting can make it difficult to assess how resources are being used and measure their impact.

In addition, California employers are required to submit annual pay data reports that help identify and address wage disparities. However, current penalties for noncompliance may not provide sufficient incentive for consistent reporting.

The Solution

SB 1237 (Blakespear) strengthens transparency, accountability, and pay equity enforcement by:

Requiring the California Civil Rights Department to publish an annual report on the use of the Civil Rights Enforcement and Litigation Fund.
Increasing penalties for repeat failures to submit required pay data reports.
Improving oversight of civil rights enforcement efforts.
Supporting efforts to identify and address workplace inequities across California.

The Civil Rights Enforcement and Litigation Fund supports this essential work; however, limited public reporting has made it difficult to fully assess its impact and ensure consistent accountability. At the same time, while employers are required to submit annual pay data reports to help identify wage disparities, current penalties for noncompliance may not be sufficient to ensure consistent and timely reporting across all employers.

SB 1237 addresses these gaps by strengthening transparency and enforcement mechanisms within California’s civil rights framework. The bill requires the Civil Rights Department to publish an annual report on fund usage, improving public accountability and providing clearer insight into how resources are being deployed to protect Californians from discrimination. It also increases penalties for repeat failures to submit required pay data reports, strengthening compliance and reinforcing the importance of accurate wage reporting in identifying and addressing pay inequities.

By improving transparency and strengthening enforcement, SB 1237 helps ensure that California’s civil rights protections are not only clearly defined, but consistently upheld in practice. These reforms support ongoing efforts to address workplace inequities and advance pay equity across the state.
