A BILL
for
1 AN ACT to make appropriations for the fiscal biennium commencing July 1, 2024
2 and ending June 30, 2026; providing definitions; providing for appropriations
3 and transfers of funds for the period of the budget and for the remainder of
4 the current biennium ending June 30, 2024 as specified; providing for
5 carryover of certain funds beyond the biennium as specified; providing for
6 employee positions as specified; providing for duties, terms and conditions
7 and other requirements relating to appropriations for the remainder of the
8 current biennium ending June 30, 2024 and the period of the budget as
9 specified; providing for position and other budgetary limitations; creating
10 accounts; amending existing law by redefining terms related to school finance
11 and redirecting revenues for the period of the budget; making conforming
12 amendments; amending and repealing prior appropriations; increasing the state
13 employer paid contribution for state employee retirement; providing for
14 reports related to appropriations; continuing an account; and providing for
15 effective dates.

17 Be It Enacted by the Legislature of the State of Wyoming:
18
19 Section 1. As used in this act:

1 (a) "Agency" means any governmental unit or branch of government
2 receiving an appropriation under this act;
3
4 (b) "Appropriation" means the authorizations granted by the
5 legislature under this act to make expenditures from and to incur obligations
6 against the general and other funds as specified;
7
8 (c) "Approved budget" means as defined by W.S. 9-2-1002(a)(xxiii);
9
10 (d) "A4" means an agency trust account;
11
12 (e) "EF" means the agency's account within the enterprise fund;
13
14 (f) "FF" means federal funds;
15
16 (g) "IS" means the agency's account within the internal service fund;
17
18 (h) "PF" means the retirement account created by W.S. 9-3-407(a);
19
20 (j) "PR" means private funding sources;
21
22 (k) "P2" means the deferred compensation account referenced in W.S.
23 9-3-507;
24
25 (m) "SR" means an agency's account within the special revenue fund;

1 (n) "S1" means water development account I created by W.S.
2 41-2-124(a)(i);

4 (o) "S2" means water development account II created by W.S.
5 41-2-124(a)(ii);

7 (p) "S4" means the local government capital construction account
8 funded by W.S. 9-4-601(a)(vi) and (b)(i)(A) and 39-14-801(e)(ix);
9
10 (q) "S5" means the "school foundation program account" or "public
11 school foundation program account" created by W.S. 21-13-306(a);
12
13 (r) "S7" means the highway fund;
14
15 (s) "S10" means the legislative stabilization reserve account;
16
17 (t) "S13" means the strategic investments and projects account;
18
19 (u) "S14" means the Wyoming tourism account;
20
21 (w) "S0" means other funds identified by footnote;
22
23 (y) "T2" means the miners' hospital permanent land income fund;
24
25 (z) "T3" means the state hospital account within the permanent land
26 fund;

1 (aa) "T4" means the poor farm account within the permanent land fund
2 as established by W.S. 9-4-310(a)(v);

4 (bb) "T0" means other expendable trust funds administered by an agency
5 for specific functions within the agency's authority;
6
7 (cc) "TT" means the tobacco settlement trust income account;
8
9 (dd) "This appropriation," when used in a footnote, shall be construed
10 as a reference to that portion of the appropriated funds identified in the
11 footnote.

13 Section 2. The following sums of money, or so much thereof as is
14 necessary, are appropriated to be expended during the two (2) years beginning
15 July 1, 2024 and ending June 30, 2026, or as otherwise specified, for the
16 purposes, programs and number of employees specified by this act and the
17 approved budget of each agency. Unless otherwise specifically provided, the
18 conditions, terms and other requirements on appropriations in this act are
19 effective until June 30, 2026, subject to accrual accounting principles.

19 1. Of this general fund appropriation, it is the intent of the legislature
20 that forty-eight thousand dollars ($48,000.00) for a customer relationship
21 management software contractor be included in the governor's office standard
22 budget for the immediately succeeding fiscal biennium.

24 2. Of this general fund appropriation, eight thousand dollars ($8,000.00) is
25 appropriated for the governor's appointees to the legislature's select

1 committee on blockchain, financial technology and digital innovation
2 technology and is effective only if the select committee remains in existence
3 for the fiscal biennium.

5 3. Of this general fund appropriation, any funds expended for wild horse or
6 burro management on the Wind River Indian Reservation are conditioned upon
7 matching funds in the ratio of one dollar ($1.00) of appropriated general
8 funds to not less than one dollar ($1.00) of matching funds from any funds
9 provided by the Eastern Shoshone Tribe or the Northern Arapaho Tribe.

11 4. Of this general fund appropriation, up to twenty thousand dollars
12 ($20,000.00) is appropriated for in-person meetings of the state emergency
13 response commission created under W.S. 35-9-153. This appropriation shall
14 not be transferred or expended for any other purpose.

16 5. Of this general fund appropriation, eight hundred thousand dollars
17 ($800,000.00) is appropriated to provide matching funds for the building
18 resilient infrastructure and communities federal grant program. This
19 appropriation shall not be transferred or expended for any other purpose.
20
21 6. (a) This general fund appropriation shall be deposited into the federal
22 natural resource policy account. All funds within the federal natural
23 resource policy account are appropriated and available for expenditure by the
24 governor in accordance with W.S. 9-4-218, including expenditure by the

1 governor for litigation costs incurred by Wyoming counties involved in
2 litigation related to any of the following:

4 (i) Federal land, water, air, mineral and other natural resource
5 policies that may affect the state or counties pursuant to W.S.
6 9-4-218(a)(iii);
7
8 (ii) Treaties between the United States and a federally
9 recognized Indian tribe.

11 7. (a) Of this general fund appropriation, fifteen million dollars
12 ($15,000,000.00) is appropriated for phase III of the Wyoming innovation
13 partnership. The following shall apply to this appropriation:
14
15 (i) Up to four hundred thousand dollars ($400,000.00) may be
16 expended for one (1) or more at-will employee contract positions within the
17 personal services series (100 series) or through the contractual services
18 series (900 series) as necessary to administer, monitor and inform the joint
19 appropriations committee at regular intervals on the status, metrics, outputs
20 and outcomes of the Wyoming innovation partnership;
21
22 (ii) No funds shall be expended until the governor determines
23 that appropriate metrics have been established to measure the intended
24 outputs and outcomes of the Wyoming innovation partnership and that the

1 expenditures will result in a reasonable likelihood of successfully achieving
2 the identified metrics. The governor's office shall include a report of the
3 established metrics and results within any budget request submitted under
4 W.S. 9-2-1013 in which the office seeks additional funding for the
5 partnership;

7 (iii) Expenditures shall be approved by the governor and
8 reported to the joint appropriations committee through the B-11 process as
9 authorized by W.S. 9-2-1005(b)(ii) and reported pursuant to W.S. 9-2-1013(b);

11 (iv) This appropriation shall not be transferred or expended for
12 any other purpose. It is the intent of the legislature that this
13 appropriation not be included within the office of the governor's standard
14 budget for the immediately succeeding fiscal biennium.

16 (b) The appropriation in subsection (a) of this footnote shall not be
17 subject to Section 307 of this act.

6 1. No funds appropriated under this section shall be expended without
7 specific legislative authorization for the secretary of state or the office
8 of the secretary of state to initiate any litigation or participate in any
9 litigation initiated in a court outside of Wyoming in which the state, the
10 secretary of state or the office of the secretary of state is not a named
11 party.

13 2. Of this general fund appropriation, ninety thousand dollars ($90,000.00)
14 is for costs of publication required by W.S. 22-20-104 for any joint
15 resolution adopted by the legislature that would propose amendment to the
16 constitution on the 2024 statewide election ballot. It is the intent of the
17 legislature that this appropriation not be included in the secretary of
18 state's standard budget for the immediately succeeding fiscal biennium. This
19 appropriation shall not be transferred or expended for any other purpose and
20 any unexpended, unobligated funds remaining from this appropriation shall
21 revert as provided by law on December 31, 2024.

12 hundred ten dollars ($175,210.00) is to restore funding for two (2) vacant
13 positions within the state auditor's office.
