Voter qualifications-durational residency requirement.

A BILL
for
1 AN ACT relating to elections; requiring a qualified elector
2 to be a bona fide resident of the state of Wyoming for not
3 less than thirty (30) days before the date of the election
4 in which they offer to vote; providing an exception for
5 electors otherwise qualified to vote for president and vice
6 president of the United States; making conforming changes;
7 and providing for an effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 18-16-102(a)(ix)(E), (F) and by
12 creating a new subparagraph (G), 22-1-102(a)(xxvi),
13 22-3-102(a) by creating a new paragraph (vi) and by
14 creating a new subsection (f), 22-3-103(b) and

1 22-29-104(a)(v)(E), (F) and by creating a new subparagraph
2 (G) are amended to read:

4 18-16-102. Definitions.
5
6 (a) As used in this act:
7
8 (ix) "Qualified elector" means a natural person
9 who:
10
11 (E) Has not been convicted of a felony or
12 if convicted has had his civil rights or voting rights
13 restored; and
14
15 (F) Is registered to vote; and
16
17 (G) Has been a bona fide resident of
18 Wyoming for not less than thirty (30) days before the date
19 of the election at which he offers to vote.

21 22-1-102. Definitions.

1 (a) The definitions contained in this chapter apply
2 to words and phrases used in this Election Code and govern
3 the construction of those words and phrases unless they are
4 specifically modified by the context in which they appear.
5 As used in this Election Code:
6
7 (xxvi) "Qualified elector" includes every
8 citizen of the United States who is a bona fide resident of
9 Wyoming, has been a bona fide resident of Wyoming for not
10 less than thirty (30) days before the date of the election
11 at which he offers to vote, has registered to vote and will
12 be at least eighteen (18) years of age on the day of the
13 election at which he may offer to vote. No person is a
14 qualified elector who is a currently adjudicated mentally
15 incompetent person, or who has been convicted of a felony
16 and his civil or voting rights have not been restored. A
17 literacy test shall not be imposed as a condition to voting
18 in any election;

20 22-3-102. Qualifications; temporary registration.

22 (a) A person may register to vote not less than
23 fourteen (14) days before an election, at any election

1 specified in W.S. 22-2-101(a)(i) through (viii) or as
2 provided by W.S. 22-3-117, who satisfies the following
3 qualifications:

5 (vi) He has been a bona fide resident of Wyoming
6 for not less than thirty (30) days before the date of the
7 election at which he offers to vote.

9 (f) Any elector who meets all of the qualifications
10 of subsection (a) of this section except the elector has
11 not resided in Wyoming for thirty (30) days or more before
12 the date of a presidential election at which he offers to
13 vote, shall be qualified to vote for president and vice
14 president of the United States but for no other offices.

16 22-3-103. Furnishing of oath forms; contents thereof.

18 (b) Following the provision of the information
19 required in subsection (a) of this section, the form shall
20 require the applicant's signature in full below the
21 following oath:

1 I, ...., do solemnly swear (or affirm) that I am a citizen
2 of the United States; that I am a bona fide resident of the
3 state of Wyoming and this county; I have resided in the
4 state for not less than thirty (30) days before the date of
5 the election; that if registered in another county or
6 state, I hereby request that my registration be withdrawn;
7 that I will be at least eighteen (18) years of age on or
8 before the next election; that I am not currently
9 adjudicated a mentally incompetent person, that I have not
10 been convicted of a felony, or if I have been convicted of
11 a felony, I have had my civil or voting rights restored by
12 a competent authority; and that the voter registration
13 information contained herein is true and accurate to my
14 best knowledge and belief.

1 22-29-104. Definitions when principal act is silent.
2
3 (a) When used in a principal act, the following
4 definitions apply, unless the term is otherwise
5 specifically defined in that principal act:
6
7 (v) "Qualified elector" means a natural person
8 who:
9
10 (E) Has not been convicted of a felony, or,
11 if so convicted, has had his civil or voting rights
12 restored; and
13
14 (F) Has registered to vote; and
15
16 (G) Has been a bona fide resident of
17 Wyoming for not less than thirty (30) days before the date
18 of the election at which he offers to vote.

1 Section 2. This act is effective immediately upon
2 completion of all acts necessary for a bill to become a law
3 as provided by Article 4, Section 8 of the Wyoming
4 Constitution.
