11 This draft legislation appropriates $166,145,759 for school
12 capital construction needs based on the Select Committee on
13 School Facilities' (Select Committee) FY 2025-2026 biennial
14 budget recommendation for K-12 school facilities to the
15 Joint Appropriations Committee and the Governor.

17 Please note, the draft legislation does not include the FY
18 2025-2026 funding amounts recommended for: 1) the operation

1 of the State Construction Department or the School
2 Facilities Commission; 2) engineering and technical costs;
3 and 3) major maintenance. These amounts are traditionally
4 appropriated in the general government appropriations bill
5 through agency 027 – State Construction Department. The
6 School Facilities Commission recommended the following
7 amounts:
8
9 1) Engineering and technical costs - $700,000.00; and
10 2) Major maintenance - $176,112,379.00.
11
12 The budget submitted by the School Facilities Commission
13 did not include costs for the operation of the State
14 Construction Department or the School Facilities Commission
15 as included in prior budget requests to the Select
16 Committee.

18 In previous bill drafts, a priority was designated for each
19 project that was tied to the capacity or condition
20 schedules. The School Facilities Commission's budget did
21 not include prioritized schedules and did not identify
22 whether a project qualified for a remedy based on condition
23 or capacity. As a result, this draft does not include such
24 designations.

26 The appropriations for K-12 facilities incorporated in this
27 draft are from the Public School Foundation Program
28 Account. Recall, the School Capital Construction Account
29 will be eliminated pursuant to 2023 Wyoming Session Laws,
30 Chapter 175, effective July 1, 2024.

37 (a) This section shall consist of funds appropriated
38 for K-12 school building and facility needs.

1 (b) The amounts appropriated from the public school
2 foundation program account under paragraphs (h)(i), (ii),
3 (vii) and (viii) of this section are for the period
4 commencing on the effective date of the appropriation and
5 ending June 30, 2026, and any unexpended, unobligated funds
6 remaining from any of these appropriations shall revert to
7 the public school foundation program account on June 30,
8 2026.

10 (c) Each amount appropriated from the public school
11 foundation program account for a school facility project
12 under paragraphs (h)(iii), (iv), (v), (vi) and (ix) of this
13 section shall remain in effect from the effective date of
14 the appropriation until that project is completed, unless
15 otherwise provided by law. Upon completion of a project
16 under this subsection, any unexpended, unobligated funds
17 remaining from the appropriation for the project shall
18 revert to the public school foundation program account.

20 (d) As authorized under W.S. 21-15-119(a)(iii), the
21 school facilities commission may submit a supplemental
22 budget request for the period beginning July 1, 2025 and
23 ending June 30, 2026, for any emergency or unanticipated

1 need, or for any refinement or modification of a project
2 funded under this section, subject to any constraints or
3 other requirements imposed by the governor under W.S.
4 9-2-1013.

6 (e) An estimated schedule for deploying projects
7 funded by amounts appropriated under subsection (h) of this
8 section, as adopted by the school facilities commission and
9 as contained within the 2025-2026 biennial budget submitted
10 by the commission under W.S. 21-15-119, shall be used by
11 the state construction department to the extent practicable
12 to guide expenditure of appropriated funds. The estimated
13 schedule shall be based upon information, processes, events
14 and expenditures and shall not be binding upon the state
15 construction department or the school facilities
16 commission.

18 (f) Amounts appropriated under subsection (h) of this
19 section shall not be construed to be an entitlement or
20 guaranteed amount and shall be expended by the school
21 facilities commission to ensure adequate, efficient and
22 cost effective school buildings and facilities in
23 accordance with W.S. 21-15-114(a)(vii).

2 (g) In addition to accounting and reporting
3 requirements imposed under W.S. 28-11-301(c)(iv), the state
4 construction department shall report at least one (1) time
5 each year on the deployment of amounts to fund projects
6 under this section in accordance with the deployment
7 schedule, information on project progression and, if
8 applicable, the rationale for any deviation from the
9 estimated schedule. The reports, as approved by the
10 commission, shall be submitted by the department to the
11 select committee on school facilities, the joint
12 appropriations committee and the governor.

14 (h) The following amounts are appropriated from the
15 public school foundation program account to the school
16 facilities commission for the following purposes:
17
18 (i) For charter school leases, two million two
19 hundred sixty-seven thousand three hundred two dollars
20 ($2,267,302.00). The funds appropriated under this
21 paragraph shall be distributed for charter school lease
22 expenses for school years 2024-2025 and 2025-2026 and are
23 subject to W.S. 21-3-110(a)(x) and the following prescribed
