Municipal services-recovery actions.

A BILL
for
1 AN ACT relating to municipal services; prohibiting
2 municipalities from recovering past due payments for
3 municipal services as specified; specifying applicability;
4 and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 15-1-126 is amended to read:
9
10 15-1-126. Collecting city or town monies; settlement
11 date.

13 (a) Every officer and employee collecting or
14 receiving monies belonging to the city or town shall settle
15 with the treasurer on or before the last day of each month,

1 or as directed by the governing body, and immediately pay
2 all money into the treasury for the benefit of the funds to
3 which the monies belong. If the last day of the month
4 falls on Sunday, or a legal holiday, the payment shall be
5 made on the next preceding business day.

7 (b) When a tenant resides on a property and the
8 property owner does not reside on the property, a city or
9 town that operates a trash or recycling collection service,
10 municipal waterworks or sanitary sewer system shall not
11 collect or attempt to collect more than two (2) months of
12 past due payments from a property owner for those services.

14 Section 2. Nothing in this act shall be construed to
15 modify or impair any existing contract or obligation
16 between a property owner and a city or town executed before
17 the effective date of this act.

19 Section 3. This act is effective July 1, 2023.
