A BILL
for
1 AN ACT relating to worker's compensation; requiring
2 worker's compensation coverage premiums and rates to be
3 competitive with nationwide coverage premiums and rates;
4 requiring reporting; and providing for effective dates.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 27-14-201(a) is amended to read:
9
10 27-14-201. Rates and classifications; rate surcharge.

12 (a) The worker's compensation program shall be
13 neither more nor less than self-supporting. For the period
14 beginning January 1, 2024 and ending December 31, 2028

1 rates for coverage under this act shall not exceed the
2 average of the bottom one-third (1/3) of national state
3 worker's compensation coverage rates, provided however,
4 that if meeting the average rate determined under this
5 subsection would not be actuarially sound then the rates
6 for coverage under this act shall not exceed the average
7 national rate for a period of more than two (2) years.
8 National coverage rates by state shall be determined by the
9 department of workforce services. Employments affected by
10 this act shall be divided by the division into classes,
11 whose rates may be readjusted annually as the division
12 actuarially determines. Any employer may contest his
13 classification as determined by the division following the
14 contested case provisions of the Wyoming Administrative
15 Procedure Act except that the division shall carry the
16 burden of proving that the classification is correct.
17 Information shall be kept of the amounts collected and
18 expended in each class for actuarially determining rates,
19 but for payment of compensation, the worker's compensation
20 account shall be one and indivisible.

1 Section 2. The department of workforce services shall
2 determine national worker's compensation coverage rates by
3 state and not later than January 1, 2024.

5 Section 3.

7 (a) Except as provided in subsection (b) of this
8 section, this act is effective immediately upon completion
9 of all acts necessary for a bill to become law as provided
10 by Article 4, Section 8 of the Wyoming Constitution.

12 (b) Section 1 of this act is effective January 1,
13 2024.
