A BILL
for
1 AN ACT relating to crimes and offenses; creating a new
2 offense for child abuse; providing a penalty; providing
3 exceptions; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 6-2-503 by creating new subsections
8 (d) and (e) are amended to read:
9
10 6-2-503. Child abuse; penalty.
11
12 (d) A person is guilty of child abuse, a felony
13 punishable by imprisonment for not more than ten (10)
14 years, if a person intentionally inflicts upon a child

1 under the age of eighteen (18) years any procedure, drug,
2 other agent or combination thereof that is administered to
3 intentionally or knowingly change the sex of the child.
4 Consent of the child, the child's parents, guardian or any
5 other person responsible for the child's welfare shall not
6 be a defense to the crime defined by this subsection.

8 (e) The following do not constitute child abuse
9 pursuant to subsection (d) of this section:

11 (i) Medical treatment and any associated
12 aftercare to create the clear sexual identity of a child
13 born with an ambiguous sexual identity, provided the
14 ambiguity is diagnosed before the child reaches the age of
15 four (4) years;

17 (ii) Medical treatment and any associated
18 aftercare of a child born with the external genitalia of a
19 female and a chromosomal structure of a male or medical
20 treatment of a child born with the external genitalia of a
21 male and a chromosomal structure of a female;

1 (iii) Treatment of a child who develops, in
2 whole or in part, one (1) or more characteristics of the
3 opposite sex, provided the medical treatment and any
4 associated aftercare is intended to ameliorate the
5 characteristic and does not change the sex of the child;

7 (iv) Medical treatment and any associated
8 aftercare necessary for traumatic injuries or life
9 threatening physical diseases or conditions, not including
10 any psychological or emotional conditions.

12 Section 2. This act is effective July 1, 2023.
