Safe school and climate act amendments.

A BILL
for
1 AN ACT relating to the safe school and climate act;
2 clarifying application of the act; modifying requirements;
3 making conforming amendments; and providing for an
4 effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 21-4-313(a)(intro) and 21-4-314(a),
9 (b)(iii), (iv), (ix), (c) and (e) are amended to read:
10
11 21-4-313. Prohibition against harassment,
12 intimidation or bullying; reporting to school officials.
13
14 (a) No person, including but not limited to students,
15 school or district employees, administrators or volunteers,
16 shall engage in:

2 21-4-314. School district implementation; state
3 policies, training and technical assistance.

5 (a) Not later than December 31, 2009, Each school
6 district shall adopt a policy prohibiting, at a minimum,
7 harassment, intimidation or bullying at school. The school
8 district shall involve parents and guardians, school
9 employees, volunteers, students, administrators and
10 community representatives in the process of creating the
11 policy. The policy shall address harassment, intimidation
12 or bullying occurring or received at school committed by
13 any person, including but not limited to students, school
14 or district employees, administrators and volunteers.
15 Policies created under this section shall be continuously
16 reviewed and may be revised as necessary.

18 (b) The policy prohibiting harassment, intimidation
19 or bullying shall include, without limitation:
20
21 (iii) Consequences and appropriate remedial
22 actions for persons, including but not limited to students,
23 school or district employees, administrators and

1 volunteers, committing acts of harassment, intimidation or
2 bullying or engaging in reprisal or retaliation;

4 (iv) Procedures for reporting and documenting
5 acts of harassment, intimidation or bullying, including a
6 provision for reporting anonymously. However, formal
7 disciplinary action shall not be taken solely on the basis
8 of an anonymous report. The procedures shall identify the
9 appropriate school personnel responsible for receiving a
10 report and investigating a complaint, including procedures
11 for investigation of anonymous reports;

13 (ix) A process for discussing the district's
14 harassment, intimidation or bullying policy with students,
15 school or district employees, administrators and
16 volunteers; and
17
18 (c) To assist local school districts in developing a
19 policy under subsection (b) of this section, the department
20 of education shall not later than September 1, 2009 2023,
21 develop model policies applicable to grades kindergarten
22 through twelve (12) and teacher preparation program
23 standards on the identification and prevention of bullying.

1 In addition, the department shall provide necessary
2 training programs and technical assistance to districts in
3 carrying out this act.

5 (e) Information regarding the school district's
6 policy against harassment, intimidation or bullying shall
7 be incorporated into each district's professional
8 development programs and shall be provided to volunteers
9 and other noncertified employees of the district who have
10 significant contact with students.

12 Section 2. This act is effective July 1, 2023.
