A BILL
for
1 AN ACT to make appropriations for the fiscal biennium commencing July 1, 2022
2 and ending June 30, 2024; providing definitions; providing for appropriations
3 and transfers of funds for the period of the budget and for the remainder of
4 the current biennium as specified; providing for carryover of certain funds
5 beyond the biennium as specified; providing for employee positions as
6 specified; providing for duties, terms and conditions and other requirements
7 relating to appropriations for the remainder of the current biennium and the
8 period of the budget as specified; providing for position and other budgetary
9 limitations; amending existing law by redirecting revenues and making
10 transfers for the period of the budget; modifying teacher incentive pay for
11 the period of the budget; providing for reports related to appropriations;
12 creating an account; and providing for effective dates.

14 Be It Enacted by the Legislature of the State of Wyoming:
15
16 Section 1. As used in this act:
17
18 (a) "Agency" means any governmental unit or branch of government
19 receiving an appropriation under this act;

1 (b) "Appropriation" means the authorizations granted by the legislature
2 under this act to make expenditures from and to incur obligations against the
3 general and other funds as specified;
4
5 (c) "Approved budget" means as defined by W.S. 9-2-1002(a)(xxiii);
6
7 (d) "ARP" means any unexpended, unobligated funds received by the state
8 of Wyoming from Section 602(c)(1)(C) of Title VI of the federal Social
9 Security Act, as created by Section 9901 of the American Rescue Plan Act of
10 2021, P.L. 117-2, for the provision of government services to the extent of
11 the state of Wyoming's reduction in revenue and that were appropriated in 2021
12 Wyoming Session Laws, Chapter 166, Section 5(b);
13
14 (e) "A4" means agency trust account;
15
16 (f) "EF" means the agency's account within the enterprise fund;
17
18 (g) "FF" means federal funds;
19
20 (h) "IS" means the agency's account within the internal service fund;
21
22 (j) "PF" means the retirement account created by W.S. 9-3-407(a);
23
24 (k) "PR" means private funding sources;
25
26 (m) "P2" means the deferred compensation account referenced in W.S.
27 9-3-507;

1 (n) "SR" means an agency's account within the special revenue fund;

3 (o) "S1" means water development account I created by W.S.
4 41-2-124(a)(i);
5
6 (p) "S2" means water development account II created by W.S.
7 41-2-124(a)(ii);
8
9 (q) "S4" means the local government capital construction account funded
10 by W.S. 9-4-601(a)(vi) and (b)(i)(A) and 39-14-801(e)(ix);
11
12 (r) "S5" means the school foundation program account;
13
14 (s) "S6" means the school capital construction account;
15
16 (t) "S7" means the highway fund;
17
18 (u) "S10" means the legislative stabilization reserve account;
19
20 (w) "S13" means the strategic investments and projects account;
21
22 (y) "S0" means other funds identified by footnote;
23
24 (z) "T2" means the miners' hospital permanent land income fund;
25
26 (aa) "T3" means the state hospital permanent land fund;

1 (bb) "T4" means the poor farm account within the permanent land fund as
2 established by W.S. 9-4-310(a)(v);

4 (cc) "T5" means the Hathaway scholarship expenditure account;
5
6 (dd) "T0" means other expendable trust funds administered by an agency
7 for specific functions within the agency's authority;
8
9 (ee) "TT" means the tobacco settlement trust income account;
10
11 (ff) "This appropriation" when used in a footnote shall be construed as
12 a reference to that portion of the appropriated funds identified in the
13 footnote.

15 Section 2. The following sums of money, or so much thereof as is
16 necessary, are appropriated to be expended during the two (2) years beginning
17 July 1, 2022 and ending June 30, 2024, or as otherwise specified, for the
18 purposes, programs and number of employees specified by this act and the
19 approved budget of each agency. Unless otherwise specifically provided, the
20 conditions, terms and other requirements on appropriations in this act are
21 effective until June 30, 2024, subject to accrual accounting principles.

21 1. Of this general fund appropriation, up to one million two hundred fifty
22 thousand dollars ($1,250,000.00) is appropriated for one (1) or more at-will
23 employee contract positions within the personal services series (100 series)
24 or through the contractual services series (900 series) as necessary to
25 enhance the state's opportunities to secure infrastructure grants. As a
26 condition of this appropriation, the governor's office shall regularly report

1 the result of expenditures and grants secured from expenditures under this
2 footnote to the legislature through the joint appropriations committee. It is
3 the intent of the legislature that this appropriation not be included within
4 the office of the governor's standard budget for the immediately succeeding
5 fiscal biennium. This appropriation shall not be transferred or expended for
6 any other purpose. This appropriation shall not be subject to Section 307 of
7 this act. Of this appropriation, six hundred fifty thousand dollars
8 ($650,000.00) is effective immediately.

10 2. Of this general fund appropriation, one hundred twenty-five thousand
11 dollars ($125,000.00) is for purposes of identifying impediments and acting on
12 opportunities to improve Wyoming's access to export growth in international
13 markets. This appropriation shall not be transferred or expended for any
14 other purpose.

16 3. Of this general fund appropriation, one hundred twenty thousand dollars
17 ($120,000.00) shall only be available for expenditure if there is a change of
18 governor as a result of the 2022 general election. This appropriation is for
19 transition staff salaries, travel, expenses incurred in relocating to and from
20 the governor's mansion and other related office expenses, except that up to
21 twenty thousand dollars ($20,000.00) of this appropriation may be expended for
22 purposes of defraying moving expenses for gubernatorial appointees who are
23 required to move to Cheyenne and not more than five thousand dollars
24 ($5,000.00) is appropriated for any one (1) appointee. It is the intent of the

1 legislature that this appropriation not be included within the office of the
2 governor's standard budget for the immediately succeeding fiscal biennium.
3 This appropriation shall not be transferred or expended for any other purpose.

5 4. This general fund appropriation shall be deposited into the federal
6 natural resource policy account. It is the intent of the legislature that
7 this appropriation not be included within the office of the governor's
8 standard budget for the immediately succeeding fiscal biennium.

10 5. Of this general fund appropriation deposited into the federal natural
11 resource policy account subject to footnote 4 of this section, one million
12 dollars ($1,000,000.00) is appropriated for the Black Hills national forest
13 plan revision. This appropriation shall not be transferred or expended for
14 any other purpose.

16 6. Subject to footnote 5 of this section, all funds within the federal
17 natural resource policy account are appropriated and available for expenditure
18 by the governor in accordance with W.S. 9-4-218.
19
20 7. (a) Of this general fund appropriation, twenty-seven million five hundred
21 thousand dollars ($27,500,000.00) is appropriated for phase II of the Wyoming
22 innovation partnership. The following shall apply to this appropriation:

1 (i) Up to four hundred thousand dollars ($400,000.00) may be
2 expended for one (1) or more at-will employee contract positions within the
3 personal services series (100 series) or through the contractual services
4 series (900 series) as necessary to administer, monitor and report at regular
5 intervals to the joint appropriations committee on the Wyoming innovation
6 partnership;

8 (ii) No funds shall be expended until the governor makes a
9 determination that appropriate metrics have been established to measure the
10 intended outputs and outcomes of the Wyoming innovation partnership and the
11 expenditures will result in a reasonable likelihood of successfully achieving
12 the identified metrics. The governor's office shall include a report of the
13 established metrics and results within any biennial budget request submitted
14 under W.S. 9-2-1013 in which the office seeks additional funding for the
15 partnership;

17 (iii) Expenditures shall be approved by the governor and reported
18 to the joint appropriations committee through the B-11 process as authorized
19 by W.S. 9-2-1005(b)(ii) and reported pursuant to W.S. 9-2-1013(b);
20
21 (iv) This appropriation shall not be transferred or expended for
22 any other purpose. It is the intent of the legislature that this appropriation
23 not be included within the office of the governor's standard budget for the
24 immediately succeeding fiscal biennium.

2 (b) The appropriation in subsection (a) of this footnote shall not be
3 subject to Section 307 of this act.

18 1. Of this general fund appropriation, sixty-four thousand dollars
19 ($64,000.00) is appropriated for costs of publication required by W.S.
20 22-20-104 for any joint resolution adopted by the legislature that would
21 propose amendment to the constitution on the 2022 statewide election ballot.
22 It is the intent of the legislature that this appropriation not be included in
23 the secretary of state's standard budget for the immediately succeeding fiscal
24 biennium. This appropriation shall not be transferred or expended for any

2 appropriation shall revert as provided by law on June 30, 2023.

4 2. Of this general fund appropriation, ten thousand dollars ($10,000.00)
5 shall only be available for expenditure if there is a change of secretary of
6 state as a result of the 2022 general election. This appropriation is for
7 transition staff salaries, travel and other related office expenses. It is the
8 intent of the legislature that this appropriation not be included in the
9 secretary of state's standard budget for the immediately succeeding fiscal
10 biennium. This appropriation shall not be transferred or expended for any
11 other purpose.

13 3. Of this general fund appropriation, forty-two thousand dollars
14 ($42,000.00) is appropriated for in-state and out-of-state travel expenses.
