Citizen actions to compel financial reporting compliance.

A BILL
for
1 AN ACT relating to the administration of government;
2 authorizing citizen mandamus actions to compel compliance
3 with statutory requirements for governmental entities to
4 file reports with the department of audit; providing for
5 attorney fees; and providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 9-1-510 by creating new subsections
10 (d) and (e) is amended to read:
11
12 9-1-510. Instructions to public officers; failure of
13 public officer to obey.
14
15 (d) Should any county, city, town or special district
16 or other entity described in W.S. 16-4-125(c) or specified

1 in W.S. 16-12-202(a) fail to comply with the mandatory
2 reporting requirement contained in W.S. 9-1-507(a)(vii),
3 the following persons may institute a mandamus action
4 pursuant to W.S. 1-30-101 et seq. against the county, city,
5 town, special district or other entity to compel compliance
6 with W.S. 9-1-507(a)(vii):

8 (i) A resident of the noncompliant county, city
9 or town; or
10
11 (ii) A person residing within the boundaries of
12 the noncompliant special district or other entity who has
13 within the previous year paid taxes or fees used by the
14 noncompliant special district or other entity to support
15 its operations or projects.

17 (e) If judgment in a mandamus action instituted
18 pursuant to subsection (d) of this section is given in
19 favor of the person instituting the mandamus action, the
20 person instituting the mandamus action shall be awarded
21 reasonable attorney fees in addition to costs.
