A BILL
for
1 AN ACT relating to substance abuse and mental health
2 treatment; amending the Court Supervised Treatment Programs
3 Act to specify that certain accreditations are not required
4 for reimbursement; specifying that certain accreditations
5 are not necessary for reimbursement of substance abuse and
6 mental health services; specifying applicability; requiring
7 rulemaking; and providing for effective dates.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 7-13-1605(c) by creating a new
12 paragraph (iv) and 35-1-620(b) by creating a new paragraph
13 (xii) are amended to read:

1 7-13-1605. Establishment of court supervised program
2 account; rules and regulations; panel created; program
3 funding.

5 (c) The department shall promulgate rules and
6 regulations necessary to implement this act, including
7 establishing standards consistent with the key components
8 of drug courts defined by the United States department of
9 justice or such similar rules as may be adopted by the
10 department. The rules shall:

12 (iv) Not require a program to be accredited in
13 order for an entity providing mental health or substance
14 abuse services for a drug court to receive funding under
15 this act, including accreditation by the commission on
16 accreditation of rehabilitation facilities, the joint
17 commission on accreditation of health care organizations or
18 the national integrated accreditation for health care
19 organizations.

21 35-1-620. Powers and duties of the department and its
22 divisions.

1 (b) The department shall:

3 (xii) Not require any person or entity providing
4 mental health or substance abuse services under this
5 article to be accredited by the commission on accreditation
6 of rehabilitation facilities, the joint commission on
7 accreditation of health care organizations or the national
8 integrated accreditation for health care organizations in
9 order for the person or entity to receive or qualify for
10 funding or payment under this article.

12 Section 2. Nothing in this act shall be construed to
13 alter or impair any contract entered into before the
14 effective date of this section.

16 Section 3. The department of health shall promulgate
17 all rules necessary to implement the provisions of this
18 act.

1 Section 4.

3 (a) Except as provided in subsection (b) of this
4 section, this act is effective July 1, 2022.
5
6 (b) Sections 3 and 4 of this act are effective
7 immediately upon completion of all acts necessary for a
8 bill to become law as provided by Article 4, Section 8 of
9 the Wyoming Constitution.
