A BILL
for
1 AN ACT relating to land management; providing for state
2 management of wild horses and burros with tribes, other
3 states and private entities; amending a definition and
4 providing definitions; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 11-30-115(a) and by creating a new
9 subsection (c) is amended to read:
10
11 11-30-115. Unlawful killing of wild horses and
12 burros; state management with other agencies and tribes.

14 (a) For purposes of this section "wild horse" means a
15 horse, mare, filly or colt which is any unbranded and

1 unclaimed and lives on state or horse or burro on public
2 land lands.

4 (c) Upon the failure or refusal of the federal
5 government to manage in accordance with federal law the
6 appropriate population of any wild horses claimed by the
7 federal government as belonging to a herd management area,
8 the state is authorized to manage wild horses on state
9 lands, including, with agreement, on the Wind River Indian
10 Reservation. The state is authorized to enter into
11 cooperative agreements among state and local agencies and
12 with the Eastern Shoshone Tribe, the Northern Arapaho
13 Tribe, an official cooperative tribal governing body,
14 adjacent states, nongovernmental organizations or other
15 private entities. A cooperative agreement under this
16 subsection may provide for any cooperative undertaking to
17 manage wild horses, including population reduction tactics,
18 permanent and temporary fertility control techniques, and
19 expanding or increasing the number of wild horse training
20 and adoption programs and other removal activities. As used
21 in this subsection:

1 (i) "Cooperative undertaking" includes an
2 existing program, or a program created pursuant to this
3 subsection, administered by a state agency or any party to
4 the cooperative agreement;
5
6 (ii) "Wild horse training and adoption programs"
7 includes programs with any state correctional facility
8 under W.S. 25-13-104.

10 Section 2. This act is effective immediately upon
11 completion of all acts necessary for a bill to become law
12 as provided by Article 4, Section 8 of the Wyoming
13 Constitution.
