A BILL
for
1 AN ACT relating to alcoholic beverages; authorizing the
2 issuance of resort retail liquor licenses for restaurants
3 operating in airports as specified; making conforming
4 amendments; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 12-4-401(a) and by creating a new
9 subsection (d) and 12-4-404 are amended to read:
10
11 12-4-401. Resort retail liquor licenses; authorized;
12 qualifications; provision for licenses issued prior to July
13 1, 2022.

1 (a) The appropriate licensing authority in a county,
2 city or town may issue resort retail liquor licenses to
3 applicants who are owners or lessees of a resort complex
4 where the resort complex satisfies the requirements of
5 subsection (b) of this section and to applicants who are
6 owners or lessees of a restaurant operating in an airport
7 where the restaurant satisfies the requirements of
8 subsection (d) of this section.

10 (d) To qualify for a resort retail liquor license at
11 an airport restaurant, the appropriate licensing authority
12 shall require the restaurant to:
13
14 (i) Be located within an airport that offers or
15 provides commercial air service to the general public; and
16
17 (ii) Be a restaurant that seats not less than
18 fifty (50) persons.

20 12-4-404. Sale of beverages for off-premises
21 consumption prohibited.

1 Except as otherwise provided in this section, resort liquor
2 licensees shall not sell alcoholic or malt beverages for
3 consumption off the premises owned or leased by the
4 licensee, except pursuant to a catering permit. Resort
5 liquor licensees that satisfy the requirements of W.S.
6 12-4-401(d) shall not under any circumstances sell
7 alcoholic or malt beverages for consumption off the
8 premises owned or leased by the licensee. The dispensing of
9 alcoholic or malt beverages licensed to be sold hereunder
10 shall be controlled by W.S. 12-5-201 and if a catering
11 permit has been issued by W.S. 12-4-502(b).

13 Section 2. This act is effective July 1, 2022.
