Off-road recreational vehicle operation.

A BILL
for
1 AN ACT relating to motor vehicles; specifying requirements
2 for operating an off-road vehicle near an interstate; and
3 providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 31-5-124(c) and 31-5-1601(c) and (e)
8 are amended to read:
9
10 31-5-124. Off-road recreational vehicles;
11 multipurpose vehicles; limitation on use; equipment.

13 (c) Off-road recreational vehicles shall not be
14 operated on the roadway or right-of-way of an interstate
15 highways highway except in accordance with W.S. 31-5-1601.

2 31-5-1601. Operation on highways.

4 (c) As used in this section, "public road
5 right-of-way" means the entire right-of-way of a street,
6 road or highway within Wyoming, including the traveled
7 portions, banks, ditches, shoulders and medians of a
8 street, road or highway except as provided in subsection
9 (e) of this section.

11 (e) Off-road recreational vehicles as defined in W.S.
12 31-1-101(a)(xv)(K) shall not be operated on the roadway or
13 right-of-way of an interstate highways highway except that
14 an off-road vehicle under this subsection:
15
16 (i) May operate adjacent to the interstate
17 roadway on a trail where there is a physical barrier
18 between the trail and the interstate highway and the trail
19 is designated, marked or signed as a Wyoming off-road
20 recreational vehicle trail pursuant to W.S. 31-2-701
21 through 31-2-707, provided:

1 (A) The off-road vehicle is operated by a
2 person with a valid class of driver's license for the type
3 of motor vehicle being operated; and
4
5 (B) The off-road vehicle displays a license
6 plate pursuant to W.S. 31-2-232 or an off-road recreational
7 vehicle decal pursuant to W.S. 31-2-702 through 31-2-704.
8
9 (ii) Shall not cross the interstate roadway for
10 any reason, except through an opening in the physical
11 barrier between the trail and the interstate highway at a
12 designated crossing in the marked or signed Wyoming
13 off-road recreational vehicle trail.

15 Section 2. This act is effective July 1, 2022.
