Scratch tickets-outdoor recreation funding.

A BILL
for
1 AN ACT relating to the Wyoming lottery; authorizing
2 scratch-off ticket games; providing for the distribution of
3 net proceeds attributable to scratch-off ticket games;
4 creating an account; requiring funds in the account to be
5 expended to support outdoor recreation as specified; making
6 conforming amendments; authorizing the adoption of
7 regulations; providing applicability; and providing for
8 effective dates.

10 Be It Enacted by the Legislature of the State of Wyoming:
11
12 Section 1. W.S. 9-17-129 is created to read:

1 9-17-129. Outdoor recreation office funding account;
2 deposit of scratch-off ticket game proceeds;
3 administration.

5 There is created the outdoor recreation office funding
6 account. The state treasurer shall credit to the account
7 those funds attributable to scratch-off ticket games as
8 specified under W.S. 9-17-111(b). Interest and other
9 earnings on funds within the account shall be credited to
10 the account. Funds in the account shall be expended by the
11 department of state parks and cultural resources upon
12 appropriation by the legislature to support outdoor
13 recreation areas and facilities.

15 Section 2. W.S. 9-17-103(a)(vi), 9-17-108(a)(i) and
16 9-17-111(b)(intro) are amended to read:

18 9-17-103. Definitions.
19
20 (a) As used in this chapter:
21
22 (vi) "Lottery," "lotteries," "lottery game" or
23 "lottery games" means any game of chance approved by the

1 board and operated pursuant to this chapter, specifically
2 limited to a state lottery, or a multi-state lottery and
3 state and multi-state scratch-off ticket games, and shall
4 not include other instant tickets, scratch-off tickets,
5 video lottery terminals or any other electronic game
6 involving direct physical contact between the player and a
7 machine;

9 9-17-108. Adoption by board of procedures regulating
10 conduct of lottery games.

12 (a) The board may adopt regulations, policies and
13 procedures regulating the conduct of lottery games in
14 general, including, but not limited to, regulations,
15 policies and procedures specifying:
16
17 (i) The type of games to be conducted,
18 specifically limited to a state lottery, or a multi-state
19 lottery, and state and multi-state scratch-off ticket games
20 and shall not include other instant-win tickets,
21 scratch-off ticket games, video lottery terminals or any
22 other electronic game involving direct physical contact
23 between the player and a machine;

2 9-17-111. Disposition of lottery proceeds.

4 (b) On or before the fifteenth day of each quarter,
5 the corporation shall transfer to the treasurer's office,
6 for credit to the lottery account which is hereby created,
7 at least seventy-five percent (75%) of the all lottery game
8 net proceeds from the preceding quarter. Final
9 reconciliation of the transfer to the state under this
10 subsection shall be determined at the end of each fiscal
11 year based on the audited annual financial statements. Net
12 proceeds attributable to scratch-off ticket games shall be
13 accounted for separately from all other net proceeds. Upon
14 their deposit into the account, any monies representing a
15 deposit of net proceeds shall then become the unencumbered
16 property of the state of Wyoming and the corporation shall
17 have no power to agree or undertake otherwise. At least
18 once per fiscal year, net proceeds attributable to
19 scratch-off ticket games credited to the lottery account
20 shall be paid by the state treasurer to the outdoor
21 recreation office funding account created by W.S. 9-17-129.
22 At least once per fiscal year, these monies all other net
23 proceeds credited to the lottery account shall be paid by

1 the treasurer to the treasurers of the counties, cities and
2 towns for payment into their respective general funds. The
3 percentage of the balance that will be distributed to each
4 county and its cities and towns will be determined by
5 computing the percentage that sales of lottery tickets
6 collected by retailers in each county including its cities
7 and towns bear to total sales of lottery tickets collected
8 by retailers in all counties including their cities and
9 towns. This percentage of the monies shall be distributed
10 within each county as follows:

12 Section 3. The amendments to W.S. 9-17-111(b) made by
13 this act shall apply to net proceeds attributable to
14 scratch-off ticket games generated on or after January 1,
15 2023.

17 Section 4. The Wyoming lottery corporation shall take
18 action as necessary to bring scratch-off ticket games to
19 market by January 1, 2023 or as soon thereafter as is
20 practicable, including conducting market research, creating
21 a launch strategy and distribution methodology and adopting
22 regulations, policies or procedures relating to the conduct
23 of scratch-off ticket games.

2 Section 5.

4 (a) Except as provided in subsection (b) of this
5 section, this act is effective January 1, 2023.
6
7 (b) Sections 4 and 5 of this act are effective
8 immediately upon completion of all acts necessary for a
9 bill to become law as provided by Article 4, Section 8 of
10 the Wyoming Constitution.
