A BILL
for
1 AN ACT relating to state employees; providing vaccination
2 incentives to state employees in response to COVID-19
3 vaccine mandates; providing definitions; making an
4 appropriation; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1.

10 (a) In light of the significant reduction in
11 mortality and other benefits provided by COVID-19
12 vaccinations and to incentivize state employees for their
13 safety and continued dedication during this pandemic, each
14 eligible state employee who has been or will become fully
15 vaccinated for COVID-19 on or before December 31, 2021,

1 shall receive incentive pay of one thousand dollars
2 ($1,000.00). Incentive pay under this section is provided
3 in response to COVID-19 vaccine mandates and is intended to
4 voluntarily increase COVID-19 vaccination rates. Only those
5 state employees who are continuously employed on and after
6 the effective date of this act and continuing through
7 December 31, 2021, shall be eligible for the incentive pay
8 provided by this section.

10 (b) As used in this section:
11
12 (i) "COVID-19" means as defined by W.S.
13 1-1-141(a)(ii);
14
15 (ii) "Fully vaccinated for COVID-19" means a
16 person has received all manufacturer recommended shots of a
17 vaccine that is marketed to prevent COVID-19 or a vaccine
18 that is marketed to diminish or decrease the symptoms of
19 COVID-19, not including booster shots;
20
21 (iii) "State employee" means any employee of the
22 state of Wyoming working full-time, including on a contract
23 basis, for any branch of the state of Wyoming government

1 including the executive, legislative and judicial branches
2 of government, the University of Wyoming and any
3 department, division, agency, board, commission or other
4 instrumentality of those branches. "State employee" shall
5 not include any elected official whose salary is prescribed
6 by law.

8 Section 2.

10 (a) There is appropriated fourteen million seven
11 hundred twenty thousand dollars ($14,720,000.00) to the
12 state auditor from any unexpended, unobligated American
13 Rescue Plan Act funds that were appropriated in 2021
14 Wyoming Session Laws, Chapter 166, Section 5(b). Pursuant
15 to subsection (b) of this section, from this appropriation
16 the state auditor shall distribute the following amounts:
17
18 (i) Nine million dollars ($9,000,000.00) for
19 distribution among the executive branch agencies for
20 employees of the executive branch, the commission on
21 judicial conduct and ethics and the community college
22 commission but not including any agency or entity specified
23 in paragraph (ii) or (iii) of this subsection;

2 (ii) Three million one hundred fifty thousand
3 dollars ($3,150,000.00) to the University of Wyoming for
4 eligible state employees of the University of Wyoming, the
5 University of Wyoming medical education program and the
6 enhanced oil recovery commission;

8 (iii) Two million one hundred fifty thousand
9 ($2,150,000.00) to the community college commission to be
10 further distributed among the community colleges for
11 eligible state employees of the community colleges and
12 Wyoming public television;
13
14 (iv) Three hundred seventy thousand dollars
15 ($370,000.00) to the supreme court to be further
16 distributed among the eligible state employees of the
17 supreme court, district courts and circuit courts and
18 related subdivisions;
19
20 (v) Fifty thousand dollars ($50,000.00) to the
21 legislative service office for eligible state employees of
22 the legislature.

1 (b) The appropriation under subsection (a) of this
2 section is for purposes of providing incentive pay under
3 section 1 of this act and that are consistent with the
4 terms of the American Rescue Plan Act, excluding the
5 provision of government services related to a reduction in
6 revenue. Any unobligated, unexpended funds remaining from
7 this appropriation on June 31, 2022, may be transferred and
8 expended upon approval by the governor for any other
9 purposes authorized by the legislature and consistent with
10 the terms of the American Rescue Plan Act. Transfers and
11 expenditures under this section shall be reported to the
12 legislature through the B-11 process as authorized by W.S.
13 9-2-1005(b)(ii) and reported pursuant to W.S. 9-2-1013(b).
14 As used in this section, "American Rescue Plan Act funds"
15 means funds appropriated or disbursed to the state of
16 Wyoming through the Coronavirus State Fiscal Recovery Fund
17 established under section 602 of title VI of the federal
18 Social Security Act, as created by section 9901 of the
19 American Rescue Plan Act of 2021, P.L. No. 117-2.

21 Section 3. This act is effective immediately upon
22 completion of all acts necessary for a bill to become law

1 as provided by Article 4, Section 8 of the Wyoming
2 Constitution.
