A BILL
for
1 AN ACT relating to Medicaid; providing for the expansion of
2 Medicaid eligibility; limiting the continued expansion of
3 Medicaid eligibility as specified; repealing prior
4 authorizations; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 42-4-501 is created to read:

1 (a) The director of the department, the insurance
2 commissioner and the governor shall as soon as practicable
3 negotiate with the centers for Medicare and Medicaid
4 services of the United States department of health and
5 human services to obtain a state plan amendment or other
6 federal authorization to provide Medicaid coverage for all
7 persons described under section 1902(a)(10)(A)(i)(VIII) of
8 the Social Security Act, 42 U.S.C. §
9 1396a(a)(10)(A)(i)(VIII).

11 (b) Any expansion of the Medicaid program under this
12 section shall not be administered during any time period in
13 which the increased federal medical assistance percentage,
14 as currently provided under 42 U.S.C. § 1396d(y), is less
15 than ninety percent (90%), nor shall the eligibility
16 expansion program be administered during any time period in
17 which the regular federal medical assistance percentage
18 under 42 U.S.C. § 1396d(b) is less than fifty‑five percent
19 (55%).

21 Section 2. 2013 Wyoming Session Laws, Chapter 116,
22 Section 5 is repealed.

1 Section 3. This act is effective immediately upon
2 completion of all acts necessary for a bill to become law
3 as provided by Article 4, Section 8 of the Wyoming
4 Constitution.
