Incest amendments.

A BILL
for
1 AN ACT relating to crimes and offenses; amending the
2 relationships required for the crime of incest; amending
3 the penalty for incest; and providing for an effective
4 date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 6-4-402(a)(i) through (iii), by
9 creating new paragraphs (iv) and (v) and (b) is amended to
10 read:
11
12 6-4-402. Incest; penalties; disclosure or publication
13 of identifying information; "minor victim".

1 (a) A person is guilty of incest if he knowingly
2 commits sexual intrusion, as defined by W.S.
3 6-2-301(a)(vii), or sexual contact, as defined by W.S.
4 6-2-301(a)(vi), with an ancestor or descendant or a brother
5 or sister of the whole or half blood. The relationships
6 referred to herein include relationships of:

8 (i) Parent and child or siblings by adoption
9 when one or both of the adopted siblings is a minor and
10 living in the same household;
11
12 (ii) Blood relationships without regard to
13 legitimacy; and
14
15 (iii) Stepparent and stepchild. or step siblings
16 when one or both of the step siblings is a minor and living
17 in the same household;
18
19 (iv) Legal guardian and child or persons with
20 the same legal guardian when one or both of the persons
21 with the same legal guardian is a minor and living in the
22 same household; and

1 (v) Foster parent and foster child or persons
2 with the same foster parent when one or both of the persons
3 with the same foster parent is a minor and living in the
4 same household.

6 (b) Incest is a felony punishable by: imprisonment
7 for not more than fifteen (15) years, a fine of not more
8 than ten thousand dollars ($10,000.00), or both.

10 (i) Except as provided in paragraph (ii) of this
11 subsection, imprisonment for not less than five (5) nor
12 more than twenty (20) years and a fine of not more than ten
13 thousand dollars ($10,000.00), or both;
14
15 (ii) If the person is eighteen (18) years of age
16 or older and the victim is less than eighteen (18) years of
17 age, imprisonment for not less than twenty-five (25) years
18 nor more than fifty (50) years and a fine of not more than
19 ten thousand dollars ($10,000.00), or both.

21 Section 2. This act is effective July 1, 2021.
