1 AN ACT relating to taxation and revenue; prohibiting use of
2 tax revenue for lobbying; specifying applicability; and
3 providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 39-11-201 is created to read:
8
9 ARTICLE 2
10 LIMITATIONS ON EXPENDITURE OF TAX REVENUES
11
12 39-11-201. Taxpayer funds for lobbying.
13
14 (a) In no event shall any revenue collected from a
15 tax imposed under this title be expended to lobby or
16 finance any lobbying. The state of Wyoming and any agency,

1 instrumentality or political subdivision thereof receiving
2 or distributing revenue collected from a tax imposed under
3 this title shall lobby or finance any lobbying using
4 accounts that are separate and independent from any account
5 that receives revenues collected from a tax imposed under
6 this title.

8 (b) As used in this article, "lobby" or "lobbying"
9 means to attempt to influence legislation or to campaign to
10 support or oppose a candidate, initiative or referendum or
11 ballot proposition. "Lobby" or "lobbying" does not include:
12
13 (i) Testifying before a governmental committee;
14
15 (ii) Providing data, education, proposed
16 language or information on proposed legislation,
17 initiatives, referenda or ballot propositions;
18
19 (iii) Activity by a public official or public
20 employee that is conducted in furtherance of the official's
21 or employee's job duties or that informs the public
22 regarding proposed measures that may significantly impact

1 the official's or employee's government operations or
2 programs.

4 Section 2. W.S. 9-13-105(b)(intro) and (ii) is
5 amended to read:

7 9-13-105. Misuse of office.

9 (b) A public official, public member, or public
10 employee or person who receives revenue from a tax imposed
11 under title 39 of the Wyoming statutes shall not use public
12 funds, time, personnel, facilities or equipment for
13 political or campaign activity unless the use is:
14
15 (ii) Properly incidental to another activity
16 required or authorized by law and the public official,
17 public employee, or public member or other person who
18 receives revenue from a tax imposed under title 39 of the
19 Wyoming statutes allocates and reimburses the governmental
20 entity for any additional costs incurred for that portion
21 of the activity not required or authorized by law.

1 Section 3. This act applies to revenue collected on
2 or after July 1, 2021 from a tax imposed under title 39.

4 Section 4. This act is effective July 1, 2021.
