Human trafficking-minors.

A BILL
for
1 AN ACT relating to human trafficking; increasing the
2 minimum prison sentence for human trafficking in the second
3 degree to five years; prohibiting reducing or dismissing
4 human trafficking related charges involving minors as
5 specified; prohibiting expungement of a conviction for
6 human trafficking related offenses; making conforming
7 amendments; and providing for an effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 6-2-713 is created to read:
12
13 6-2-713. Prosecuting requirements when minors
14 involved.

1 Any person charged under W.S. 6-2-702(a)(iii),
2 6-2-703(a)(iii), 6-2-704, 6-2-706 or 6-2-707 shall be
3 prosecuted under that paragraph or section when the charge
4 involves a minor victim and not under a reduced charge or
5 have the charge dismissed unless the prosecuting attorney
6 in open court moves or files a statement to reduce the
7 charge or dismiss, with supporting facts, stating that
8 there is insufficient evidence to sustain the charge.

10 Section 2. W.S. 6-2-701(a)(xvi), 6-2-703(b) and
11 7-13-1502(a)(iv) by creating a new subparagraph (Y) are
12 amended to read:

16 (a) As used in this article:
17
18 (xvi) "This act" means W.S. 6-2-701 through
19 6-2-710 6-2-713.

21 6-2-703. Human trafficking in the second degree;
22 penalty.

1 (b) Except as provided in W.S. 6-2-712(a), human
2 trafficking in the second degree is a felony punishable by
3 imprisonment for not less than two (2) ten (10) nor more
4 than twenty (20) years and a fine of not more than ten
5 thousand dollars ($10,000.00), or both.

7 7-13-1502. Petition for expungement of records of
8 conviction of certain felonies; filing fee; notice;
9 objections; hearing; definitions; restoration of rights.

11 (a) A person convicted of a felony or felonies
12 subject to expungement under this section arising out of
13 the same occurrence or related course of events, may
14 petition the convicting court for an expungement of the
15 records of conviction, subject to the following
16 limitations:

18 (iv) Felonies subject to expungement under this
19 section shall not include:
20
21 (Y) Any offense punishable under W.S.
22 6-2-702 through 6-2-707.
