                                     for
 1   AN ACT relating to children; providing that parents and
 2   guardians may temporarily delegate parental authority to
 3   another person;     specifying exceptions;     specifying
 4   limitations; and providing for an effective date.
 5
 6   Be It Enacted by the Legislature of the State of Wyoming:
 7
 8           Section 1.   W.S. 3-2-401 and 14-2-207 are created to
 9   read:

12              TEMPORARY DELEGATION OF PARENTAL AUTHORITY

14          3-2-401.    Temporary delegation of parental authority.

 1          (a)   A parent or a guardian of a minor, incompetent
 2   person or ward, by a properly executed power of attorney
 3   which shall be delivered to the assignee, may delegate to
 4   another person, for a period not exceeding six (6) months,
 5   any or all of the parent's or guardian's powers regarding
 6   care, custody or property of the minor, incompetent person
 7   or ward, except that no parent or guardian shall delegate
 8   the power to:
 9
10                (i)    Consent to marriage; or
11
12                (ii)   Consent to adoption.

14          (b)   A parent or guardian executing a delegation of
15   authority under subsection (a) of this section may withdraw
16   or revoke that delegation at any time by giving written
17   notice to the person to whom authority was delegated.
18
19          (c)   Nothing in this article shall:
20
21                (i)    Diminish or limit the rights of the parent
22   or guardian to direct the care of the minor, incompetent
23   person or ward;

 2              (ii)     Affect or limit the power of any court so
 3   authorized to    appoint   a guardian,   temporary guardian or
 4   conservator for a child, incompetent person or ward under
 5   this title.

 7          14-2-207.    Temporary delegation of parental authority.
 8
 9   A parent may delegate their parental authority to another
10   person as provided by W.S. 3-2-401.
11
12          Section 2.    This act is effective July 1, 2021.
