A BILL
for
1 AN ACT relating to public health and safety; prohibiting
2 governmental entities or public employees from forcing,
3 requiring or coercing immunizations or vaccinations for
4 COVID-19 or influenza; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 35-4-140 is created to read:
9
10 35-4-140. No required vaccinations for COVID-19 or
11 influenza.

13 No governmental entity or public employee shall force,
14 require or coerce a person to receive an immunization or

1 vaccination for coronavirus disease 2019 (COVID-19), first
2 detected in Wuhan, Hubei province, People's Republic of
3 China, or influenza against the person's will, nor shall
4 the state health officer include them in any required
5 immunization under W.S. 21-4-309.

7 Section 2. W.S. 35-4-113(b)(intro) and 35-4-115(a) by
8 creating new paragraphs (iii) and (iv) are amended to read:
9
10 35-4-113. Treatment when consent is not available;
11 quarantine.

13 (b) Except as otherwise prohibited by W.S. 35-4-140,
14 during a public health emergency, the state health officer
15 may subject a person to vaccination or medical treatment
16 without consent in the following circumstances:

18 35-4-115. Definitions.

20 (a) As used in this article:
21
22 (iii) "Governmental entity" means as defined in
23 W.S. 1-39-103(a)(i);

2 (iv) "Public employee" means any employee of, or
3 person providing services as an independent contractor of,
4 a governmental entity.

6 Section 3. This act is effective immediately upon
7 completion of all acts necessary for a bill to become law
8 as provided by Article 4, Section 8 of the Wyoming
9 Constitution.
