A BILL
for
1 AN ACT relating to the legislature; prohibiting payment of
2 wages to public employees who are receiving salary as a
3 legislator; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section 1. W.S. 28-5-101 by creating a new subsection
8 (g) is amended to read:
9
10 28-5-101. Schedule of compensation, per diem and
11 travel expenses.

13 (g) A member of the legislature who is also a public
14 employee shall not receive payment of wages as a public

1 employee during any period for which the member receives
2 salary for a legislative working day or for a committee
3 work day as provided in paragraph (e)(ii) of this section.
4 This subsection shall not prohibit the accrual of other
5 benefits resulting from employment as a public employee.
6 This subsection shall not apply to the extent that the
7 member's public employee wages were earned through the use
8 of accrued annual leave or other compensatory leave during
9 the same time period. As used in this subsection, "public
10 employee" means as defined in W.S. 1-39-103(a)(iv) except
11 for any person who is only considered a public employee
12 because the person is a member of the legislature.

14 Section 2. This act is effective January 1, 2025.
