4 0307, appropriation 48000; in the amount of $305,500 from the Department of Economic
5 Development, fund 0256, fiscal year 2008, organization 0307, appropriation 48000; in the
6 amount of $136.61 from the Department of Economic Development, fund 0256, fiscal year
7 2001, organization 0307, appropriation 81900; in the amount of $3,725.24 from the
8 Department of Economic Development, fund 0256, fiscal year 2002, organization 0307,
9 appropriation 81900; in the amount of $2,420.04 from the Department of Economic
10 Development, fund 0256, fiscal year 2003, organization 0307, appropriation 81900; in the
11 amount of $6,488.43 from the Department of Economic Development, fund 0256, fiscal
12 year 2005, organization 0307, appropriation 81900; in the amount of $6,518.25 from the
13 Department of Economic Development, fund 0256, fiscal year 2006, organization 0307,
14 appropriation 81900; in the amount of $2,068.61 from the Department of Economic
15 Development, fund 0256, fiscal year 2008, organization 0307, appropriation 81900; in the
16 amount of $243,027.46 from the Department of Economic Development, fund 0256, fiscal
17 year 2010, organization 0307, appropriation 81900; in the amount of $93,244.87 from the

19 appropriation 81900; in the amount of $33,002.10 from the Department of Economic

21 amount of $86,438.58 from the Department of Economic Development, fund 0256, fiscal
22 year 2013, organization 0307, appropriation 81900; in the amount of $23,878.68 from the
23 Department of Economic Development, fund 0256, fiscal year 2014, organization 0307,
24 appropriation 81900; and in the amount of $199,262.69 from the Department of Economic
25 Development, fund 0256, fiscal year 2015, organization 0307, appropriation 81900.
26 Whereas, The Governor submitted to the Legislature the Executive Budget Document,

27 dated February 10, 2021, which included a Statement of the State Fund, General Revenue,
28 setting forth therein the cash balance as of July 1, 2020, and further included the estimate of
29 revenues for the fiscal year 2021, less net appropriation balances forwarded and regular
30 appropriations for the fiscal year 2021; and
31 Whereas, The Governor finds that account balances in funds from the Department of
32 Economic Development, fund 0256, fiscal years 2007 and 2008, organization 0307, appropriation
33 48000, and Department of Economic Development, fund 0256, fiscal years 2001, 2002, 2003,
34 2005, 2006, 2008, 2010, 2011, 2012, 2013, 2014, and 2015, organization 0307, appropriation
35 81900, exceeds that which is necessary for the purposes for which accounts were established.
36 Whereas, It appears from the Statement of the State Fund, General Revenue, and this
37 legislation, there remains an unappropriated surplus balance in the State Treasury which is
38 available for appropriation during the fiscal year ending June 30, 2021; therefore
39 Be it enacted by the Legislature of West Virginia:
1 That the balance of the funds available for expenditure in the fiscal year ending June 30,
2 2021, in the Department of Economic Development, fund 0256, fiscal year 2007, organization
3 0307, appropriation 48000, be decreased by expiring the amount of $397,450; in the Department
4 of Economic Development, fund 0256, fiscal year 2008, organization 0307, appropriation 48000,
5 be decreased by expiring the amount of $305,500; in the Department of Economic Development,
6 fund 0256, fiscal year 2001, organization 0307, appropriation 81900, be decreased by expiring
7 the amount of $136.61; in the Department of Economic Development, fund 0256, fiscal year 2002,
8 organization 0307, appropriation 81900, be decreased by expiring the amount of $3,725.24; in
9 the Department of Economic Development, fund 0256, fiscal year 2003, organization 0307,
10 appropriation 81900, be decreased by expiring the amount of $2,420.04; in the Department of
11 Economic Development, fund 0256, fiscal year 2005, organization 0307, appropriation 81900, be
12 decreased by expiring the amount of $6,488.43; in the Department of Economic Development,
13 fund 0256, fiscal year 2006, organization 0307, appropriation 81900, be decreased by expiring

15 2008, organization 0307, appropriation 81900, be decreased by expiring the amount of $2,068.61;
16 in the Department of Economic Development, fund 0256, fiscal year 2010, organization 0307,
17 appropriation 81900, be decreased by expiring the amount of $243,027.46; in the Department of
18 Economic Development, fund 0256, fiscal year 2011, organization 0307, appropriation 81900, be
19 decreased by expiring the amount of $93,244.87; in the Department of Economic Development,
20 fund 0256, fiscal year 2012, organization 0307, appropriation 81900, be decreased by expiring
21 the amount of $33,002.10; in the Department of Economic Development, fund 0256, fiscal year
22 2013, organization 0307, appropriation 81900, be decreased by expiring the amount of
23 $86,438.58; in the Department of Economic Development, fund 0256, fiscal year 2014,
24 organization 0307, appropriation 81900, be decreased by expiring the amount of $23,878.68; and
25 in the Department of Economic Development, fund 0256, fiscal year 2015, organization 0307,
26 appropriation 81900, be decreased by expiring the amount of $199,262.69 to the unappropriated
27 surplus balance of the State Fund, General Revenue, to be available for appropriation during the
28 fiscal year ending June 30, 2021.
29 And, That the total appropriation for the fiscal year ending June 30, 2021, to fund 0105,
30 fiscal year 2021, organization 0100, be supplemented and amended by increasing an existing
31 item of appropriation as follows:
