1 AN ACT to amend 255.15 (4); and to create 255.15 (3) (d) of the statutes;
2 relating to: public health campaign for prevention of tobacco and electronic
3 cigarette use and a grant program to support organizations working on youth
4 vaping and cessation services; funding for special education, the University of
5 Wisconsin System, and the technical college system; and making an
6 appropriation.
Analysis by the Legislative Reference Bureau
This bill provides additional funding to the Department of Health Services to
develop and carry out a public health campaign aimed at the prevention of initiation
of tobacco and electronic cigarette use. The bill also provides funding to DHS to
distribute grants to local and regional organizations working on youth vaping and
providing cessation services. Further, the bill provides additional funding to the
Department of Public Instruction for aids for special education and to the University
of Wisconsin System and the technical college system for purposes of maintaining
compliance with maintenance of effort requirements of the federal Consolidated
Appropriations Act, 2021, and the federal American Rescue Plan Act of 2021.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
1 SECTION 1. 255.15 (3) (d) of the statutes is created to read:
2 255.15 (3) (d) From the appropriation under s. 20.435 (1) (fm), the department
3 may develop and implement a public health campaign aimed at the prevention of
4 initiation of tobacco and electronic cigarette use and may award grants for local and
5 regional organizations working on youth vaping and providing cessation services.
6 SECTION 2. 255.15 (4) of the statutes is amended to read:
7 255.15 (4) REPORTS. Not later than April 15, 2002 2024, and annually
8 thereafter, the department shall submit to the governor and to the chief clerk of each
9 house of the legislature for distribution under s. 13.172 (2) a report that evaluates
10 the success of the grant program programs under sub. (3). The report shall specify
11 the number of grants awarded during the immediately preceding fiscal year and the
12 purpose for which each grant was made. The report shall also specify donations and
13 grants accepted by the department under sub. (5).
14 SECTION 3.0Fiscal changes.
15 (1) PUBLIC HEALTH CAMPAIGN AND GRANTS FOR VAPING PREVENTION AND CESSATION.
16 In the schedule under s. 20.005 (3) for the appropriation to the department of health
17 services under s. 20.435 (1) (fm), the dollar amount for fiscal year 2022-23 is
18 increased by $2,000,000 to fund a public health campaign aimed at the prevention
19 of initiation of tobacco and electronic cigarette use and for grants for local and
20 regional organizations working on youth vaping and providing cessation services.

1 (2) SPECIAL EDUCATION AID. In the schedule under s. 20.005 (3) for the
2 appropriation to the department of public instruction under s. 20.255 (2) (b), the
3 dollar amount for fiscal year 2022-23 is increased by $1,260,000 for aids for special
4 education under s. 115.88.
5 (3) UW SYSTEM; GENERAL PROGRAM OPERATIONS. In the schedule under s. 20.005
6 (3) for the appropriation to the Board of Regents of the University of Wisconsin
7 System under s. 20.285 (1) (a), the dollar amount for fiscal year 2022-23 is increased
8 by $267,800 for the purpose for which the appropriation is made.
9 (4) STATE AIDS FOR TECHNICAL COLLEGES. In the schedule under s. 20.005 (3) for
10 the appropriation to the technical college system board under s. 20.292 (1) (d), the
11 dollar amount for fiscal year 2022-23 is increased by $47,200 for the purpose for
12 which the appropriation is made.
