SUBSTITUTE SENATE BILL 5648

1 AN ACT Relating to including state-tribal education compact
2 schools and charter schools as entities able to receive waivers from
3 the state board of education and the office of the superintendent of
4 public instruction under the authority of RCW 28A.300.750; and
5 amending RCW 28A.300.750.
6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
7 Sec. 1. RCW 28A.300.750 and 2018 c 177 s 502 are each amended to
8 read as follows:
9 (1)(a) In accordance with the criteria adopted by the state board
10 of education under subsection (2) of this section, the superintendent
11 of public instruction may grant waivers to school districts, state-
12 tribal education compact schools established under chapter 28A.715
13 RCW, and charter public schools established under chapter 28A.710 RCW
14 from the provisions of RCW 28A.150.200 through 28A.150.220, except as
15 provided in (b) of this subsection, on the basis that such waiver or
16 waivers are necessary to implement successfully a local plan to
17 provide for all students in the district, state-tribal education
18 compact school, or charter public school an effective education
19 system that is designed to enhance the educational program for each
20 student. The local plan may include alternative ways to provide

1 effective educational programs for students who experience difficulty
2 with the regular education program.
3 (b) The state board of education shall have authority to grant
4 waivers to school districts, state-tribal education compact schools
5 established under chapter 28A.715 RCW, and charter public schools
6 established under chapter 28A.710 RCW from the provisions of RCW
7 28A.150.220(3)(b) and to grant the waivers set forth in RCW
8 28A.230.090(1)(e)(ii) and 28A.655.180.
9 (2) The state board of education shall adopt rules establishing
10 the criteria to evaluate the need for a waiver or waivers under this
11 section.
