READ FIRST TIME 02/07/23.
1 AN ACT Relating to the number of inhabitants required for
2 incorporation as a city or town; amending RCW 35.02.010 and
3 35.02.010; providing an effective date; and providing an expiration
4 date.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
6 Sec. 1. RCW 35.02.010 and 1994 c 216 s 12 are each amended to
7 read as follows:
8 Any contiguous area containing not less than ((one thousand five
9 hundred)) 1,500 inhabitants lying outside the limits of an
10 incorporated city or town may become incorporated as a city or town
11 operating under Title 35 or 35A RCW as provided in this chapter((:
12 PROVIDED, That no area which lies within five air miles of the
13 boundary of any city having a population of fifteen thousand or more
14 shall be incorporated which contains less than three thousand
15 inhabitants)).
16 Sec. 2. RCW 35.02.010 and 1994 c 216 s 12 are each amended to
17 read as follows:
18 Any contiguous area containing not less than ((one thousand five
19 hundred)) 1,500 inhabitants lying outside the limits of an
20 incorporated city or town may become incorporated as a city or town

1 operating under Title 35 or 35A RCW as provided in this chapter:
2 PROVIDED, That no area which lies within five air miles of the
3 boundary of any city having a population of ((fifteen thousand))
4 15,000 or more shall be incorporated which contains less than ((three
5 thousand)) 3,000 inhabitants.
6 NEW SECTION. Sec. 3. Section 1 of this act expires June 30,
7 2028.
8 NEW SECTION. Sec. 4. Section 2 of this act takes effect June
9 30, 2028.
