1 AN ACT Relating to electric-assisted bicycles; and creating a new
2 section.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
4 NEW SECTION. Sec. 1. (1) The department of natural resources
5 and the department of fish and wildlife shall each undergo a public
6 process to collect information related to electric-assisted bicycle
7 use on nonmotorized natural surface trails and closed roads open to
8 bicycles to determine where such use may occur, and which classes of
9 electric-assisted bicycles are acceptable on such trails and roads
10 under the agencies' management. The public processes must also
11 include a consideration of opportunities to improve awareness of
12 applicable trail rules and trail etiquette among all classes of trail
13 users.
14 (2) The public processes shall include, but not be limited
15 to, input from tribes, individuals with disabilities, representatives
16 of natural resource conservation organizations, and representatives
17 of outdoor recreation interests representing horseback riding,
18 traditional and electric-assisted mountain biking, hiking, and
19 hunting. The department of natural resources and the department of
20 fish and wildlife must report their findings to the appropriate
21 committees of the legislature by September 30, 2022.

1 (3) Until June 30, 2023, or until legislation is enacted or rules
2 are adopted related to the use of electric-assisted bicycles on
3 nonmotorized natural surface trails and closed roads on lands managed
4 by the department of natural resources and by the department of fish
5 and wildlife, whichever is earlier, the department of natural
6 resources and the department of fish and wildlife must allow persons
7 who possess a current parking placard for persons with disabilities,
8 issued by the department of transportation pursuant to RCW 46.19.030,
9 to use class 1 and class 2 electric-assisted bicycles, as defined in
10 RCW 46.04.169, on all nonmotorized natural surface trails and closed
11 roads on which bicycles are allowed.
