1 AN ACT Relating to evaluation and recommendation of candidates
2 for residency teacher certification; amending RCW 28A.410.270 and
3 28A.410.2211; adding a new section to chapter 28A.410 RCW; creating
4 new sections; repealing RCW 28A.410.280; providing an expiration
5 date; and declaring an emergency.
6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
7 NEW SECTION. Sec. 1. (1) The legislature acknowledges that
8 passing the evidence-based assessment of teaching effectiveness,
9 known as the edTPA, may be a barrier to some candidates becoming
10 fully certificated teachers in Washington. The legislature seeks to
11 promote academic success and reduce barriers for all students,
12 particularly candidates of color, candidates for whom English is a
13 second language, and candidates from low-income households. The
14 legislature is also concerned that candidates from low-income
15 households have difficulty paying for the edTPA, which is
16 administered by a third party.
17 (2) The legislature finds that the state approval process
18 requires each teacher preparation program to ensure that teacher
19 candidates demonstrate the most recently published interstate teacher
20 assessment and support consortium standards, the state-adopted
21 cultural competency standards, and the state-adopted social-emotional

1 learning standards. The legislature recognizes that teacher
2 candidates may demonstrate their knowledge, skills, and competencies
3 in a variety of ways and settings. The legislature trusts that
4 teacher preparation programs can use multiple measures to evaluate
5 whether teacher candidates meet or exceed the standards, without
6 relying on a statewide assessment. Therefore, the legislature intends
7 to eliminate taking or passing the edTPA as a prerequisite for
8 residency teacher state certification. Nothing in this legislation
9 prohibits a teacher preparation program from using the edTPA as a
10 formative tool so long as notification is included in all program
11 descriptions.
12 NEW SECTION. Sec. 2. (1) Washington professional educator
13 standards board-approved teacher preparation programs must recommend
14 for residency teacher certification each person who, during the
15 2019-20, 2020-21, or 2021-22 academic years, met all statutory and
16 program requirements except for completion of the evidence-based
17 assessment of teaching effectiveness under RCW 28A.410.280, as
18 repealed by this act. The programs must attempt to notify each person
19 who meets the requirements of this subsection of the recommendation.
20 (2) Except when required under subsection (1) of this section,
21 Washington professional educator standards board-approved teacher
22 preparation programs may, upon request, recommend for residency
23 teacher certification any person who was required to pass the
24 evidence-based assessment of teaching effectiveness under RCW
25 28A.410.280, as repealed by this act, as a prerequisite to residency
26 teacher certification, provided that the person met all other
27 statutory and program requirements in effect at the time of
28 enrollment in the teacher preparation program.
29 (3) This section expires September 1, 2022.
30 NEW SECTION. Sec. 3. A new section is added to chapter 28A.410
31 RCW to read as follows:
32 The Washington professional educator standards board may not
33 adopt rules requiring that candidates for residency teacher
34 certification take or pass a uniform, statewide performance
35 assessment of teaching effectiveness.
36 Sec. 4. RCW 28A.410.270 and 2019 c 386 s 3 are each amended to
37 read as follows:

1 (1)(a) The ((Washington professional educator standards)) board
2 shall adopt a set of articulated teacher knowledge, skill, and
3 performance standards for effective teaching that are evidence-based,
4 measurable, meaningful, and documented in high quality research as
5 being associated with improved student learning. The standards shall
6 be calibrated for each level along the entire career continuum. For
7 candidates recommended for residency teacher certification by a
8 board-approved preparation program, the standards adopted by the
9 board must be the most recent teaching standards published by a
10 consortium of state and national education organizations dedicated to
11 the reform of the preparation, licensing, and ongoing professional
12 development of teachers since 1987.
13 (b) In developing the standards, the board shall, to the extent
14 possible, incorporate standards for cultural competency, as defined
15 in RCW 28A.410.260, along the entire continuum. ((For the purposes of
16 this subsection, "cultural competency" includes knowledge of student
17 cultural histories and contexts, as well as family norms and values
18 in different cultures; knowledge and skills in accessing community
19 resources and community and parent outreach; and skills in adapting
20 instruction to students' experiences and identifying cultural
21 contexts for individual students.))
22 (c) By January 1, 2020, in order to ensure that teachers can
23 recognize signs of emotional or behavioral distress in students and
24 appropriately refer students for assistance and support, the
25 ((Washington professional educator standards)) board shall
26 incorporate along the entire continuum the social-emotional learning
27 standards and benchmarks recommended by the social-emotional learning
28 benchmarks work group in its October 1, 2016, final report titled,
29 "addressing social emotional learning in Washington's K-12 public
30 schools." In incorporating the social-emotional learning standards
31 and benchmarks, the ((Washington professional educator standards))
32 board must include related competencies, such as trauma-informed
33 practices, consideration of adverse childhood experiences, mental
34 health literacy, antibullying strategies, and culturally sustaining
35 practices.
36 (2) The ((Washington professional educator standards)) board
37 shall adopt a definition of master teacher, with a comparable level
38 of increased competency between professional certification level and
39 master level as between professional certification level and national
40 board certification. Within the definition established by the

1 ((Washington professional educator standards)) board, teachers
2 certified through the national board for professional teaching
3 standards shall be considered master teachers.
4 (3) ((The Washington professional educator standards board shall
5 maintain a uniform, statewide, valid, and reliable classroom-based
6 means of evaluating teacher effectiveness as a culminating measure at
7 the preservice level that is to be used during the student-teaching
8 field experience. This assessment shall include multiple measures of
9 teacher performance in classrooms, evidence of positive impact on
10 student learning, and shall include review of artifacts, such as use
11 of a variety of assessment and instructional strategies, and student
12 work.
13 (4))) Award of a professional certificate shall be based on a
14 minimum of two years of successful teaching experience as defined by
15 the board, and may not require candidates to enroll in a professional
16 certification program.
17 (((5))) (4) Educator preparation programs approved to offer the
18 residency teaching certificate shall be required to demonstrate how
19 the program produces effective teachers as evidenced by ((the))
20 multiple measures ((established under this section)) of the
21 knowledge, skills, performance, and competencies described in
22 subsection (1) of this section and other criteria established by the
23 ((Washington professional educator standards)) board.
24 (5) Each board-approved teacher preparation program must publish,
25 and provide to candidates prior to admission, a list of program
26 completion requirements.
27 (6) Before a board-approved teacher preparation program may
28 recommend a candidate for residency teacher certification, the
29 candidate must meet or exceed the knowledge, skill, performance, and
30 competency standards described in subsection (1) of this section.
31 (7) For the purpose of this section, "board" means the Washington
32 professional educator standards board.
33 Sec. 5. RCW 28A.410.2211 and 2011 2nd sp.s. c 2 s 2 are each
34 amended to read as follows:
35 (1) The professional educator standards board shall revise
36 assessments for prospective teachers and teachers adding subject area
37 endorsements required for teacher certification under RCW 28A.410.220
38 to measure the revised standards in RCW 28A.410.221.

1 (2) ((In implementing the evidence-based assessment of teaching
2 effectiveness under RCW 28A.410.280, the)) The professional educator
3 standards board shall require that successful candidates for the
4 residency certificate demonstrate effective subject specific
5 instructional methods that address the revised standards.
6 NEW SECTION. Sec. 6. RCW 28A.410.280 (Evidence-based assessment
7 of teaching effectiveness—Teacher preparation program requirement)
8 and 2010 c 235 s 501 are each repealed.
9 NEW SECTION. Sec. 7. This act is necessary for the immediate
10 preservation of the public peace, health, or safety, or support of
11 the state government and its existing public institutions, and takes
12 effect immediately.
