5 Subject: Consumer protection; notice; holds on payment at point of sale
6 Statement of purpose of bill as introduced: This bill proposes to require gas
7 stations and convenience stores that accept credit or debit card payments for
8 the retail sale of gasoline to provide notice to the customer if they, or a third
9 party, will place a hold on a credit or debit card payment that is for an amount
10 larger than the actual retail gasoline purchase.
11 An act relating to requiring gas stations and convenience stores to provide
12 notice to customers of holds on payment at the point of sale
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. 9 V.S.A. § 4110b is added to read:
15 § 4110b. CUSTOMER NOTICE OF HOLDS ON PAYMENT AT POINT OF
16 SALE
17 A gas station or convenience store that accepts credit or debit cards for the
18 retail sale of gasoline shall not place, or allow a third party to place, a hold on
19 any credit or debit card account in an amount larger than the actual purchase
20 amount for the gasoline without providing notice:

1 (1) in a clear manner and proximate to the point of payment prior to the
2 consumers purchase; and
3 (2) before the customer’s purchase.
4 Sec. 2. EFFECTIVE DATE
5 This act shall take effect on passage.
