8 Statement of purpose of bill as introduced: This bill proposes to require the
9 Secretary of Natural Resources to amend the Department of Environmental
10 Conservation’s Water Supply Rule to establish a maximum contaminant level
11 (MCL) of zero parts per trillion for the perfluoroalkyl and polyfluoroalkyl
12 substances (PFAS) of perfluorooctanoic acid, perfluorooctane sulfonic acid,
13 perfluorohexane sulfonic acid, perfluorononanoic acid, perfluoroheptanoic
14 acid, and perfluorodecanoic acid. The bill also would propose that the
15 Secretary of Natural Resources amend the Department of Environmental
16 Conservation’s Water Supply Rule to establish an MCL of not more than 20
17 parts per trillion for any testable PFAS other than those specifically required to
18 have an MCL of zero parts per trillion.

1 It is hereby enacted by the General Assembly of the State of Vermont:
2 Sec. 1. DEPARTMENT OF ENVIRONMENTAL CONSERVATION;
3 DRINKING WATER STANDARDS; PERFLUOROALKYL AND
4 POLYFLUOROALKYL SUBSTANCES
5 (a) As used in this section, “perfluoroalkyl and polyfluoroalkyl substances”
6 or “PFAS” means a class of fluorinated organic chemicals containing at least
7 one fully fluorinated carbon atom.
8 (b) On or before July 1, 2024, the Secretary of Natural Resources shall file
9 under 3 V.S.A. § 841 a final proposed rule with the Secretary of State and the
10 Legislative Committee on Administrative Rules establishing the following
11 under the Department of Environmental Conservation’s Water Supply Rule:
12 (1) a maximum contaminant level (MCL) of zero parts per trillion for
13 the PFAS of perfluorooctanoic acid, perfluorooctane sulfonic acid,
14 perfluorohexane sulfonic acid, perfluorononanoic acid, perfluoroheptanoic
15 acid, and perfluorodecanoic acid; and
16 (2) an MCL of not more than 20 parts per trillion total for any testable
17 PFAS combined other than those PFAS listed under subdivision (1) of this
18 subsection.
19 Sec. 2. EFFECTIVE DATE
20 This act shall take effect on July 1, 2023.
