7 Statement of purpose of bill as introduced: This bill proposes to replace
8 legislative approval with legislative oversight for changes to developmental
9 disability services policies related to payment reform and conflict-free case
10 management.
11 An act relating to legislative oversight of payment reform and conflict-free
12 case management for developmental disability services
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. PAYMENT REFORM AND CONFLICT-FREE CASE
15 MANAGEMENT; LEGISLATIVE OVERSIGHT
16 (a) At a minimum, the following shall be included in the payment reform
17 process impacting individuals with developmental disabilities, their families,
18 and designated and specialized service agencies:
19 (1) in addition to any standardized assessment utilized by the
20 Department of Disabilities, Aging, and Independent Living, a process for VT LEG #364309 v.1

1 consideration of additional information relevant to the life circumstances of
2 service recipients or applicants;
3 (2) in addition to any standardized rates or rate ranges developed by the
4 Department, a process for consideration of budgets to reflect the individualized
5 support needs of service recipients or applicants; and
6 (3) a process for evaluating the fiscal and service impact on individual
7 service recipients and the designated and specialized service agencies.
8 (b)(1) Prior to implementing the federally required conflict-free case
9 management system, the Department shall seek and consider input from a
10 variety of stakeholders, including individuals with developmental disabilities,
11 their families, designated and specialized service agencies, and other providers
12 and advocates.
13 (2) As part of the changes necessary to come into federal compliance,
14 consideration shall be given to performing initial clinical eligibility and service
15 planning within the Department.
16 (c) On or before February 1, 2023, the Department shall present any
17 proposed policy changes related to payment reform and conflict-free case
18 management to the House Committee on Human Services and the Senate
19 Committee on Health and Welfare and seek and consider input from the
20 Committees.

1 Sec. 2. REPEAL
2 2022 Acts and Resolves No. 186, Sec. 6 (payment reform and conflict-free
3 case management) is repealed.
4 Sec. 3. EFFECTIVE DATE
5 This act shall take effect on passage.
