6 Subject: Health insurance; commercial insurance coverage; epinephrine auto-
7 injectors
8 Statement of purpose of bill as introduced: This bill proposes to require
9 commercial insurance plans provide coverage for epinephrine auto-injectors
10 without any deductible, coinsurance, co-payment, or other cost-sharing
11 requirement.
12 An act relating to commercial insurance coverage of epinephrine auto-
13 injectors
14 It is hereby enacted by the General Assembly of the State of Vermont:
15 Sec. 1. 8 V.S.A. chapter 107, subchapter 15 is added to read:
16 Subchapter 15. Epinephrine
17 § 4100m. EPINEPHRINE AUTO-INJECTORS; COVERAGE REQUIRED
18 (a) As used in this section, “health insurance plan” means any individual or
19 group health insurance policy, any hospital or medical service corporation or
20 health maintenance organization subscriber contract, or any other health VT LEG #364621 v.1

1 benefit plan offered, issued, or renewed for any person in this State by a health
2 insurer, as defined by 18 V.S.A. § 9402. The term shall not include benefit
3 plans providing coverage for a specific disease or other limited benefit
4 coverage.
5 (b) A health insurance plan shall provide coverage without any deductible,
6 coinsurance, co-payment, or other cost-sharing requirement for epinephrine
7 auto-injectors when prescribed by an insured’s health care provider.
8 Sec. 2. EFFECTIVE DATE
9 This act shall take effect on July 1, 2023.
