7 LONG TITLE
8 General Description:
9 This bill authorizes programs for medical assistance provided by the state.
10 Highlighted Provisions:
11 This bill:
12 < requires the Medicaid program to apply for a waiver of state plan amendment with
13 the Centers for Medicare and Medicaid Services to provide:
14 C 12 month continuous eligibility for children enrolled in Medicaid;
15 C 12 months of postpartum coverage for women who are enrolled in Medicaid;
16 C family planning assistance for individuals at or below 250% of federal poverty
17 level; and
18 C coverage for certain pregnant women who are lawfully residing in the United
19 States;
20 < directs the Department of Health and Human Services to implement any coverage
21 for which a waiver or state plan amendment authorized under this bill is approved;
22 and
23 < requires the department to report annually to the Health and Human Services
24 Interim Committee on medical assistance authorized under this bill.

33 Be it enacted by the Legislature of the state of Utah:
34 Section 1. Section 26B-3-401 is enacted to read:
35 26B-3-401. Medicaid waivers for expanded medical assistance.
36 (1) Before January 1, 2024, the department shall apply for one or more Medicaid
37 waivers or state plan amendments with CMS to provide:
38 (a) continuous eligibility for a 12 month period for an enrollee who is a child;
39 (b) postpartum coverage for 12 months for a woman who is eligible for postpartum
40 coverage under Medicaid;
41 (c) family planning services as defined in Section 26-18-417 to an individual with a
42 household income less than or equal to 250% of federal poverty level as defined in Section
43 26-18-411; and
44 (d) coverage under 42 U.S.C. 1396b(v)(4) for pregnant women who are lawfully
45 residing in the United States.
46 (2) If a waiver or state plan amendment described in Subsection (1) is approved by
47 CMS, the department shall implement the program to the extent the program is approved by
48 CMS.
49 (3) The department may pay the state portion of the costs of medical assistance
50 provided under this section with appropriations from the Medicaid Expansion Fund created in
51 Section 26-36b-208.
52 (4) Before October 1 each year, the department shall report to the Health and Human
53 Services Interim Committee:
54 (a) the number of individuals receiving medical assistance under Subsection (2); and
55 (b) the cost of providing the medical assistance.
