8 General Description:
9 This bill creates the Kidney Health Task Force (task force).
10 Highlighted Provisions:

14 health in Utah;

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 36-29-401 is enacted to read:
33 Part 4. Kidney Health Task Force
34 36-29-401. Definitions.
35 As used in this part, "task force" means the Kidney Health Task Force created in
36 Section 36-29-402.
37 Section 2. Section 36-29-402 is enacted to read:
38 36-29-402. Task force membership.
39 (1) There is created the Kidney Health Task Force.
40 (2) The following are members of the task force:
41 (a) a member of the Senate, appointed by the president of the Senate;
42 (b) a member of the Senate, appointed by the minority leader of Senate;
43 (c) a member of the House of Representatives, appointed by the speaker of the House
44 of Representatives;
45 (d) a member of the House of Representatives, appointed by the minority leader of the
46 House of Representatives; and
47 (e) the lieutenant governor, or the lieutenant governor's designee.
48 (3) The governor shall appoint the following additional members to the task force:
49 (a) an individual representing the Department of Health and Human Services;
50 (b) an individual representing a health care system;
51 (c) an individual representing the nephrologist community;
52 (d) an individual representing the kidney patient community;
53 (e) two individuals from separate nonprofit organizations that focus on kidney disease;
54 and
55 (f) two individuals who represent any of the following:
56 (i) public health clinics;
57 (ii) community health centers;
58 (iii) minority health organizations; or

59 (iv) private health insurers.
60 (4) (a) A member appointed by the governor under Subsection (3) shall serve a
61 four-year term.
62 (b) Notwithstanding Subsection (4)(a), for the initial appointments of members
63 described in Subsection (3), the governor shall appoint four members to a two-year
64 appointment to ensure that half of the members appointed by the governor rotate every two
65 years.
66 (c) When a vacancy occurs in the membership for any reason, the applicable appointing
67 authority shall appoint a replacement for the remainder of the unexpired term of the original
68 appointment.
69 (5) The Department of Health and Human Services shall provide staff for the task
70 force.
71 Section 3. Section 36-29-403 is enacted to read:
72 36-29-403. Task force meetings.
73 (1) The task force shall annually elect a chair and vice chair from the task force's
74 membership.
75 (2) The task force shall meet at least three times each year.
76 (3) (a) A majority of the members of the task force constitutes a quorum.
77 (b) The action of a majority of a quorum constitutes the action of the task force.
78 Section 4. Section 36-29-404 is enacted to read:
79 36-29-404. Duties.
80 (1) The task force shall study issues related to:
81 (a) kidney disease, including higher rates of the disease in minority populations;
82 (b) transplantation; and
83 (c) living and deceased kidney donation.
84 (2) The task force shall provide recommendations for:
85 (a) programs that treat kidney disease;
86 (b) programs that detect kidney disease in early stages of the disease;
87 (c) programs to reduce the burden of kidney disease on patients and communities; and
88 (d) an outreach and marketing campaign that includes:
89 (i) health education workshops and seminars;

90 (ii) preventative screenings;
91 (iii) a social media campaign; and
92 (iv) television and radio commercials.
93 (3) Before November 1, 2024, and each year thereafter, the task force shall provide a
94 written report to the Health and Human Services Interim Committee regarding the
95 recommendations described in Subsection (2).
96 Section 5. Section 36-29-405 is enacted to read:
97 36-29-405. Members serve without pay -- Reimbursement for expenses.
98 (1) A member of the task force who is not a legislator may not receive compensation or
99 benefits for the member's service but may receive per diem and travel expenses as allowed in:
100 (a) Section 63A-3-106;
101 (b) Section 63A-3-107; and
102 (c) rules made by the Division of Finance according to Sections 63A-3-106 and
103 63A-3-107.
104 (2) Salary and expenses of a task force member who is a legislator shall be paid in
105 accordance with Section 36-2-2 and Legislative Joint Rules, Title 5, Legislative Compensation
106 and Expenses.
107 Section 6. Section 63I-1-236 is amended to read:
108 63I-1-236. Repeal dates: Title 36.
109 (1) Title 36, Chapter 17, Legislative Process Committee, is repealed January 1, 2028.
110 (2) Section 36-12-20 is repealed June 30, 2023.
111 (3) Title 36, Chapter 28, Veterans and Military Affairs Commission, is repealed
112 January 1, 2025.
113 (4) Section 36-29-108, Criminal Code Evaluation Task Force, is repealed July 1, 2023.
114 (5) Title 36, Chapter 29, Part 4, Kidney Health Task Force, is repealed December 31,
