8 General Description:
9 This bill renames a Utah State University regional institution as Utah State University
10 Price.
11 Highlighted Provisions:
12 This bill:
13 < renames a Utah State University regional institution as Utah State University Price;
14 and
15 < enacts provisions regarding the name change and the continuation of the institution's
16 rights and obligations.

33 Be it enacted by the Legislature of the state of Utah:
34 Section 1. Section 9-22-112 is amended to read:
35 9-22-112. High school STEM education initiative.
36 (1) Subject to legislative appropriations, after consulting with State Board of Education
37 staff, the STEM Action Center shall award grants to school districts and charter schools to fund
38 STEM related certification for high school students.
39 (2) (a) A school district or charter school may apply for a grant from the STEM Action
40 Center, through a competitive process, to fund the school district's or charter school's STEM
41 related certification training program.
42 (b) A school district's or charter school's STEM related certification training program
43 shall:
44 (i) prepare high school students to be job ready for available STEM related positions of
45 employment; and
46 (ii) when a student completes the program, result in the student gaining an
47 industry-recognized employer STEM related certification.
48 (3) A school district or charter school may partner with one or more of the following to
49 provide a STEM related certification program:
50 (a) a technical college described in Section 53B-2a-105;
51 (b) Salt Lake Community College;
52 (c) Snow College;
53 (d) Utah State University [Eastern] Price;
54 (e) Utah State University Blanding; or
55 (f) a private sector employer.
56 Section 2. Section 53B-2-104 is amended to read:
57 53B-2-104. Degree-granting institution board of trustees -- Membership -- Terms
58 -- Vacancies -- Oath -- Officers -- Bylaws -- Quorum -- Committees -- Compensation.

59 (1) As used in this section, "board of trustees" means the board of trustees for a
60 degree-granting institution.
61 (2) (a) The board of trustees of a degree-granting institution consists of the following:
62 (i) except as provided in Subsection (2)(c), eight individuals appointed by the governor
63 with the advice and consent of the Senate in accordance with Title 63G, Chapter 24, Part 2,
64 Vacancies; and
65 (ii) two ex officio members who are the president of the institution's alumni
66 association, and the president of the associated students of the institution.
67 (b) In making the appointments described in Subsections (2)(a)(i) and (2)(c)(i), the
68 governor:
69 (i) shall ensure that the membership of a board of trustees includes representation of
70 interests of business, industry, and labor; and
71 (ii) may not appoint an individual to more than two consecutive full terms.
72 (c) (i) The board of trustees of Utah State University has nine individuals appointed by
73 the governor with the advice and consent of the Senate in accordance with Title 63G, Chapter
74 24, Part 2, Vacancies.
75 (ii) One of the nine individuals described in Subsection (2)(c)(i) shall reside in the
76 Utah State University [Eastern] Price service region or the Utah State University Blanding
77 service region.
78 (3) (a) The governor shall appoint four members of each board of trustees during each
79 odd-numbered year to four-year terms commencing on July 1 of the year of appointment.
80 (b) Except as provided in Subsection (3)(d), a member appointed under Subsection
81 (2)(a)(i) or (2)(c)(i) holds office until a successor is appointed and qualified.
82 (c) The ex officio members serve for the same period as they serve as presidents and
83 until their successors have qualified.
84 (d) (i) The governor may remove a member appointed under Subsection (2)(a)(i) or
85 (2)(c)(i) for cause.
86 (ii) The governor shall consult with the president of the Senate before removing a
87 member in accordance with Subsection (3)(d)(i).
88 (4) When a vacancy occurs in the membership of a board of trustees for any reason, the
89 governor shall appoint a replacement for the unexpired term.

90 (5) (a) Each member of a board of trustees shall take the official oath of office prior to
91 assuming the office.
92 (b) The oath shall be filed with the Division of Archives and Records Services.
93 (6) A board of trustees shall elect a chair and vice chair, who serve for two years and
94 until their successors are elected and qualified.
95 (7) (a) A board of trustees may enact bylaws for the board of trustees' own government,
96 including provisions for regular meetings.
97 (b) (i) A board of trustees may provide for an executive committee in the board of
98 trustees' bylaws.
99 (ii) If established, an executive committee shall have full authority of the board of
100 trustees to act upon routine matters during the interim between board of trustees meetings.
101 (iii) An executive committee may act on nonroutine matters only under extraordinary
102 and emergency circumstances.
103 (iv) An executive committee shall report the executive committee's activities to the
104 board of trustees at the board of trustees' next regular meeting following the action.
105 (c) Copies of a board of trustees' bylaws shall be filed with the board.
106 (8) A quorum is required to conduct business and consists of six members.
107 (9) A board of trustees may establish advisory committees.
108 (10) A member may not receive compensation or benefits for the member's service, but
109 may receive per diem and travel expenses in accordance with:
110 (a) Section 63A-3-106;
111 (b) Section 63A-3-107; and
112 (c) rules made by the Division of Finance pursuant to Sections 63A-3-106 and
113 63A-3-107.
114 (11) A board of trustees member shall comply with the conflict of interest provisions
115 described in Title 63G, Chapter 24, Part 3, Conflicts of Interest.
116 Section 3. Section 53B-2-114 is enacted to read:
117 53B-2-114. Utah State University Price -- Institutional name change.
118 (1) Utah State University Eastern shall be known as Utah State University Price.
119 (2) Utah State University Price is a continuation of Utah State University Eastern and
120 shall:

121 (a) possess all rights, titles, privileges, powers, immunities, franchises, endowments,
122 property, and claims of Utah State University Eastern; and
123 (b) fulfill and perform all obligations of Utah State University Eastern, including
124 obligations relating to outstanding bonds and notes.
125 Section 4. Section 53B-2a-201 is amended to read:
126 53B-2a-201. Geographic service areas for degree-granting institutions that
127 provide technical education.
128 (1) A degree-granting institution of higher education provides technical education in
129 the geographic areas of the state described in this section.
130 (2) (a) The Snow College Richfield campus, described in Section 53B-16-205,
131 provides technical education for the geographic area encompassing:
132 (i) the Juab School District;
133 (ii) the Millard School District;
134 (iii) the Tintic School District;
135 (iv) the North Sanpete School District;
136 (v) the South Sanpete School District;
137 (vi) the Wayne School District;
138 (vii) the Piute School District; and
139 (viii) the Sevier School District.
140 (b) A Utah State University regional institution, as defined in Section 53B-16-207,
141 provides technical education for the geographic area encompassing:
142 (i) for Utah State University [Eastern] Price, described in Section 53B-18-1201:
143 (A) the Carbon School District; and
144 (B) the Emery School District;
145 (ii) for Utah State University Blanding, described in Section 53B-18-1202, the San
146 Juan School District; and
147 (iii) for Utah State University Moab, described in Section 53B-18-301, the Grand
148 School District.
149 (c) Salt Lake Community College provides technical education for the geographic area
150 encompassing:
151 (i) the Salt Lake City School District;

152 (ii) the Granite School District;
153 (iii) the Murray School District;
154 (iv) the Canyons School District; and
155 (v) the Jordan School District.
156 Section 5. Section 53B-16-207 is amended to read:
157 53B-16-207. Utah State University regional institutions -- Career and technical
158 education.
159 (1) As used in this section:
160 (a) "Utah State University regional institution" or "USU regional institution" means:
161 (i) Utah State University [Eastern] Price;
162 (ii) Utah State University Blanding; or
163 (iii) Utah State University Moab.
164 (b) "Utah State University Moab" means the Utah State University regional campus
165 located at or near Moab described in Section 53B-18-301.
166 (2) A USU regional institution shall:
167 (a) maintain a strong curriculum in career and technical education courses at the USU
168 regional institution's campus and within the region the USU regional institution serves that can
169 be transferred to other institutions within the higher education system, together with lower
170 division courses and courses required for associate degrees in science, arts, applied science, and
171 career and technical education; and
172 (b) work with school districts and charter schools in developing an aggressive
173 concurrent enrollment program.
174 Section 6. Section 53B-16-208 is amended to read:
175 53B-16-208. Utah State University career and technical education advisory
176 committee -- Membership -- Duties.
177 (1) As used in this section:
178 (a) "Service regions" means the service regions, as established by the Utah State
179 University board of trustees, for:
180 (i) Utah State University [Eastern] Price;
181 (ii) Utah State University Blanding; and
182 (iii) Utah State University Moab.

183 (b) "Utah State University Moab" means the Utah State University regional campus
184 located at or near Moab described in Section 53B-18-301.
185 (2) Utah State University shall establish a career and technical education advisory
186 committee composed of the following 13 members:
187 (a) one elected local school board member appointed by the board of education for the
188 Carbon School District;
189 (b) one elected local school board member appointed by the board of education for the
190 Emery School District;
191 (c) one elected local school board member appointed by the board of education for the
192 Grand School District;
193 (d) one elected local school board member appointed by the board of education for the
194 San Juan School District;
195 (e) nine members appointed by the Utah State University president that include:
196 (i) one member of the Utah State University [Eastern] Price regional advisory council
197 described in Section 53B-18-1201;
198 (ii) one member of the Utah State University Blanding regional advisory council
199 described in Section 53B-18-1202;
200 (iii) one member representing Utah State University Moab; and
201 (iv) six representatives of business or industry from members of the program advisory
202 committees overseeing career and technical education in the service regions.
203 (3) The career and technical education advisory committee shall:
204 (a) prepare a comprehensive strategic plan for delivering career and technical education
205 within the service regions, after consulting with:
206 (i) Utah State University [Eastern] Price;
207 (ii) Utah State University Blanding;
208 (iii) Utah State University Moab; and
209 (iv) school districts and charter schools within the service regions;
210 (b) make recommendations regarding what skills are needed for employment in Utah
211 businesses and industries;
212 (c) recommend programs based upon the information gathered in accordance with
213 Subsection (3)(b);

214 (d) review annual program evaluations;
215 (e) provide counsel, support, and recommendations for updating and improving the
216 effectiveness of career and technical education programs and services, including expedited
217 program approval and termination of procedures, consistent with board policy;
218 (f) monitor program advisory committees and other advisory groups to provide
219 counsel, support, and recommendations for updating and improving the effectiveness of
220 training programs and services; and
221 (g) coordinate with local school boards, districts, and charter schools to meet the career
222 and technical education needs of secondary students.
223 Section 7. Section 53B-18-1201 is amended to read:
224 53B-18-1201. Utah State University Price -- Establishment -- Regional advisory
225 council.
226 (1) As used in this section:
227 (a) "University" means Utah State University.
228 (b) "Vice president" means the vice president described in Subsection (5).
229 (2) (a) There is established a comprehensive regional college of the university called
230 Utah State University [Eastern] Price.
231 (b) The university shall:
232 (i) possess all rights, title, privileges, powers, immunities, franchises, endowments,
233 property, and claims of the College of [Eastern] Price Utah; and
234 (ii) fulfill and perform all obligations of Utah State University [Eastern] Price,
235 including obligations relating to outstanding bonds and notes.
236 (3) (a) Utah State University [Eastern] Price has a campus that serves Price, Utah, and
237 surrounding areas.
238 (b) The university board of trustees shall establish Utah State University [Eastern]
239 Price's service region.
240 (4) Utah State University [Eastern] Price is under the authority and direction of the
241 university president and the university board of trustees.
242 (5) Utah State University [Eastern] Price shall be administered by a vice president of
243 the university appointed by the university president.
244 (6) (a) The university president shall appoint a regional advisory council to advise the

245 university president and the vice president regarding local issues relating to Utah State
246 University [Eastern] Price.
247 (b) The vice president shall provide the university president with recommendations for
248 membership on the regional advisory council.
249 (c) The regional advisory council may include:
250 (i) a student representative; or
