9 LONG TITLE
10 General Description:
11 This bill allows for Medicaid reimbursement for diabetes prevention services.
12 Highlighted Provisions:
13 This bill:
14 < defines terms;
15 < authorizes the Medicaid program to reimburse a provider for certain diabetes
16 prevention services;
17 < implements a reporting requirement;
18 < sets a termination date for the reimbursement but requires legislative review before
19 the termination date; and
20 < makes technical changes.
21 Money Appropriated in this Bill:
22 This bill appropriates in fiscal year 2023:
23 < to the Department of Health and Human Services -- Integrated Health Care
24 Services, as an ongoing appropriation:
25 C from the General Fund, $87,500; and
26 C from the Medicaid Expansion Fund, $6,000.

36 Be it enacted by the Legislature of the state of Utah:
37 Section 1. Section 26-18-28 is enacted to read:
38 26-18-28. Reimbursement for diabetes prevention program.
39 (1) As used in this section, "DPP" means the National Diabetes Prevention Program
40 developed by the United States Centers for Disease Control and Prevention.
41 (2) Beginning July 1, 2022, the Medicaid program shall reimburse a provider for an
42 enrollee's participation in the DPP if the enrollee:
43 (a) meets the DPP's eligibility requirements; and
44 (b) has not previously participated in the DPP after July 1, 2022, while enrolled in the
45 Medicaid program.
46 (3) Subject to appropriation, the Medicaid program may set the rate for reimbursement.
47 (4) The department may apply for a state plan amendment if necessary to implement
48 this section.
49 (5) (a) On or after July 1, 2025, but before October 1, 2025, the department shall
50 provide a written report regarding the efficacy of the DPP and reimbursement under this
51 section to the Health and Human Services Interim Committee.
52 (b) The report described in Subsection (5)(a) shall include:
53 (i) the total number of enrollees with a prediabetic condition as of July 1, 2022;
54 (ii) the total number of enrollees as of July 1, 2022, with a diagnosis of type 2 diabetes;
55 (iii) the total number of enrollees who participated in the DPP;
56 (iv) the total cost incurred by the state to implement this section; and

57 (v) any conclusions that can be drawn regarding the impact of the DPP on the rate of
58 type 2 diabetes for enrollees.
59 Section 2. Section 63I-1-226 is amended to read:
60 63I-1-226. Repeal dates, Title 26.
61 (1) Subsection 26-1-7(1)(f), related to the Residential Child Care Licensing Advisory
62 Committee, is repealed July 1, 2024.
63 (2) Subsection 26-1-7(1)(h), related to the Primary Care Grant Committee, is repealed
64 July 1, 2025.
65 (3) Section 26-1-7.5, which creates the Utah Health Advisory Council, is repealed July
66 1, 2025.
67 (4) Section 26-1-40 is repealed July 1, 2022.
68 (5) Section 26-1-41 is repealed July 1, 2026.
69 (6) Section 26-7-10 is repealed July 1, 2025.
70 (7) Subsection 26-7-11(5), regarding reports to the Legislature, is repealed July 1,
71 2028.
72 (8) Section 26-7-14 is repealed December 31, 2027.
73 (9) Title 26, Chapter 9f, Utah Digital Health Service Commission Act, is repealed July
74 1, 2025.
75 (10) Subsection 26-10-6(5), which creates the Newborn Hearing Screening Committee,
76 is repealed July 1, 2026.
77 (11) Section 26-10b-106, which creates the Primary Care Grant Committee, is repealed
78 July 1, 2025.
79 (12) Subsection 26-15c-104(3), relating to a limitation on the number of
80 microenterprise home kitchen permits that may be issued, is repealed [on] July 1, 2022.
81 (13) Subsection 26-18-2.6(9), which addresses reimbursement for dental hygienists, is
82 repealed July 1, 2028.
83 (14) Section 26-18-27 is repealed July 1, 2025.
84 (15) Section 26-18-28 is repealed June 30, 2027.

113 The following sums of money are appropriated for the fiscal year beginning July 1,
114 2022, and ending June 30, 2023. These are additions to amounts previously appropriated for
115 fiscal year 2023. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
116 Act, the Legislature appropriates the following sums of money from the funds or accounts
117 indicated for the use and support of the government of the state of Utah.
