Last 6 444444444444444444444444444444444444444444444444444444444444444444444 7 LONG TITLE 8 General Description: 9 This bill supplements or reduces appropriations otherwise provided for the support and 10 operation of state government for the fiscal year beginning July 1, 2020 and ending June 30, 2021 11 and for the fiscal year beginning July 1, 2021 and ending June 30, 2022. 12 Highlighted Provisions: 13 This bill: 14 < provides budget increases and decreases for the use and support of certain state agencies, 15 public education programs, and institutions of higher education; 16 < appropriates federal funds associated with the American Rescue Plan Act; 17 < makes technical corrections in the fiscal year 2021 and fiscal year 2022 budgets; 18 < provides funds for the bills with fiscal impact passed in the 2021 First Special Session; 19 < establishes rates and fees; 20 < provides budget increases and decreases for other purposes as described; 21 < provides intent language. 22 Money Appropriated in this Bill: 23 This bill appropriates $107,770,199 in operating and capital budgets for fiscal year 2021, 24 including: 25 < $122,500 from the General Fund; and 26 < $107,647,699 from various sources as detailed in this bill. 27 This bill appropriates $6,207,200 in expendable funds and accounts for fiscal year 2021. 28 This bill appropriates $203,062,500 in business-like activities for fiscal year 2021. 29 This bill appropriates $1,005,800 in restricted fund and account transfers for fiscal year 2021, 30 all of which is from the Education Fund. 31 This bill appropriates $2,156,661,900 in operating and capital budgets for fiscal year 2022, 32 including: 33 < ($4,278,800) from the General Fund; 34 < ($893,800) from the Education Fund; and S.B. 1001 Enrolled Copy 35 < $2,161,834,500 from various sources as detailed in this bill. 36 This bill appropriates $26,571,500 in expendable funds and accounts for fiscal year 2022. 37 This bill appropriates $217,703,800 in business-like activities for fiscal year 2022. 38 This bill appropriates ($40,000,000) in restricted fund and account transfers for fiscal year 39 2022, all of which is from the General Fund. 40 This bill appropriates $92,000,000 in capital project funds for fiscal year 2022, including: 41 < $2,000,000 from the General Fund; and 42 < $90,000,000 from various sources as detailed in this bill. 43 Other Special Clauses: 44 Section 1 of this bill takes effect immediately. Section 2 of this bill takes effect on July 1, 45 2021. 46 Utah Code Sections Affected: 47 ENACTS UNCODIFIED MATERIAL 48 444444444444444444444444444444444444444444444444444444444444444444444 49 Be it enacted by the Legislature of the state of Utah: 50 Section 1. FY 2021 Appropriations. The following sums of money are appropriated for the 51 fiscal year beginning July 1, 2020 and ending June 30, 2021. These are additions to amounts 52 otherwise appropriated for fiscal year 2021. 53 Subsection 1(a). Operating and Capital Budgets. Under the terms and conditions of 54 Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of 55 money from the funds or accounts indicated for the use and support of the government of the state of 56 Utah. 57 EXECUTIVE OFFICES AND CRIMINAL JUSTICE 58 UTAH DEPARTMENT OF CORRECTIONS 59 ITEM 1 To Utah Department of Corrections - Programs and Operations 60 The Legislature intends that the Department of Corrections, 61 Adult Probation and Parole Programs, is granted authority for 62 Fiscal Year 2021 and Fiscal Year 2022 to purchase one truck 63 with plow with Department funds. 64 JUDICIAL COUNCIL/STATE COURT ADMINISTRATOR 65 ITEM 2 To Judicial Council/State Court Administrator - Administration 66 Notwithstanding intent language passed in Executive 67 Offices and Criminal Justice Base Budget (Senate Bill 6, 2021 68 General Session) Item 10, under Section 63J-1-603(3) of the 69 Utah Code, the Legislature intends that appropriations of up to 70 $3,500,000 provided to the Judicial Council/State Court 71 Administrator - Administration in Laws of Utah 2020 Chapter -2- Enrolled Copy S.B. 1001 72 4, Item 91 shall not lapse at the close of Fiscal Year 2021. The 73 use of nonlapsing funds is limited to training, education 74 assistance, and incentives; translation and interpreter services; 75 IT programming and contracted support; computer equipment 76 and software; courts security; special projects and studies; 77 temporary employees (law clerks); trial court program support 78 and senior judge assistance; grant match; furniture and repairs; 79 and purchase of Utah code and rules for judges. 80 DEPARTMENT OF HUMAN SERVICES - DIVISION OF JUVENILE JUSTICE SERVICES 81 ITEM 3 To Department of Human Services - Division of Juvenile Justice 82 Services - Programs and Operations 83 From Federal Funds, One-Time 26,000 84 Schedule of Programs: 85 Community Provider Payments 26,000 86 INFRASTRUCTURE AND GENERAL GOVERNMENT 87 DEPARTMENT OF ADMINISTRATIVE SERVICES 88 ITEM 4 To Department of Administrative Services - Finance - Mandated 89 From Federal Funds - American Rescue Plan, One-Time 8,900,000 90 Schedule of Programs: 91 Emergency Disease Response 8,900,000 92 The Legislature intends that before closing out fiscal year 93 2021, to the maximum extent allowable under applicable 94 federal law or guidelines, the Department of Administrative 95 Services use up to $8,900,000 in State Fiscal Relief grants 96 provided by the American Rescue Plan Act for COVID-19 97 Response before using the General Fund appropriation 98 provided for that purpose. The Department of Administrative 99 Services shall lapse back to the General Fund all unused 100 General Fund appropriations for COVID-19 Response up to 101 $8,900,000 when closing-out fiscal year 2021 and shall provide 102 a report showing the use of funds from the State Fiscal Relief 103 Grants to the Governor's Office of Planning and Budget and to 104 the Office of Legislative Fiscal Analyst. 105 The Legislature intends that funds appropriated by this item 106 for COVID-19 Response may only be expended or distributed 107 for purposes that comply with the legal requirements and 108 federal guidelines under the American Rescue Plan Act of -3- S.B. 1001 Enrolled Copy 109 2021. 110 TRANSPORTATION 111 ITEM 5 To Transportation - Engineering Services 112 From Federal Funds, One-Time 1,000,000 113 Schedule of Programs: 114 Program Development 1,000,000 115 BUSINESS, ECONOMIC DEVELOPMENT, AND LABOR 116 GOVERNOR'S OFFICE OF ECONOMIC DEVELOPMENT 117 ITEM 6 To Governor's Office of Economic Development - Administration 118 From Federal Funds - American Rescue Plan, One-Time 3,000,000 119 Schedule of Programs: 120 Administration 3,000,000 121 The Legislature intends that before closing out fiscal year 122 2021, to the maximum extent allowable under applicable 123 federal law or guidelines, the Governor's Office of Economic 124 Development use up to $3 million in State Fiscal Relief grants 125 provided by the American Rescue Plan Act for InUtah 126 Pandemic Outreach before using the General Fund 127 appropriation provided for that purpose. The Governor's Office 128 of Economic Development shall lapse back to the General 129 Fund all unused General Fund appropriations for InUtah 130 Pandemic Outreach up to $3 million when closing-out fiscal 131 year 2021 and shall provide a report showing the use of funds 132 from the State Fiscal Relief Grants to the Governor's Office of 133 Planning and Budget and to the Office of Legislative Fiscal 134 Analyst. 135 The Legislature intends that funds appropriated by this item 136 for InUtah Pandemic Outreach may only be expended or 137 distributed for purposes that comply with the legal 138 requirements and federal guidelines under the American 139 Rescue Plan Act of 2021. 140 ITEM 7 To Governor's Office of Economic Development - Business 141 Development 142 From Federal Funds - American Rescue Plan, One-Time 15,000,000 143 Schedule of Programs: 144 Corporate Recruitment and Business Services 15,000,000 145 The Legislature intends that before closing out fiscal year -4- Enrolled Copy S.B. 1001 146 2021, to the maximum extent allowable under applicable 147 federal law or guidelines, the Governor's Office of Economic 148 Development use up to $15 million in State Fiscal Relief grants 149 provided by the American Rescue Plan Act for Economic 150 Development Grants before using the General Fund 151 appropriation provided for that purpose. The Governor's Office 152 of Economic Development shall lapse back to the General 153 Fund all unused General Fund appropriations for Economic 154 Development Grants up to $15 million when closing-out fiscal 155 year 2021 and shall provide a report showing the use of funds 156 from the State Fiscal Relief Grants to the Governor's Office of 157 Planning and Budget and to the Office of Legislative Fiscal 158 Analyst. 159 The Legislature intends that the Governor's Office of 160 Economic Development, in accordance with the American 161 Rescue Plan Act, use $15 million provided by this item to 162 assist small businesses that experienced a high level of revenue 163 decline in a consecutive four month period in 2020 compared 164 to the same period in 2019 or began operations after January 1, 165 2020, and can demonstrate the effects of COVID-19 on the 166 business and provide evidence of solvency. 167 Notwithstanding the intent language in Current Fiscal Year 168 Supplemental Appropriations (House Bill 3, Item 33, 2021 169 General Session), the Legislature intends that $5,000,000 of the 170 appropriation for Economic Development Grants in Current 171 Fiscal Year Supplemental Appropriations (House Bill 3, Item 172 33, 2021 General Session) be used to assist Utah organizations 173 that promote and support economic opportunity and provide 174 services related to live events, industry, education, community, 175 or infrastructure, giving priority to applications that create jobs 176 and support target industries within the State. 177 ITEM 8 To Governor's Office of Economic Development - Talent Ready 178 Utah Center 179 From Federal Funds - American Rescue Plan, One-Time 15,000,000 180 Schedule of Programs: 181 Talent Ready Utah Center 15,000,000 182 The Legislature intends that before closing out fiscal year -5- S.B. 1001 Enrolled Copy 183 2021, to the maximum extent allowable under applicable 184 federal law or guidelines, the Governor's Office of Economic 185 Development use up to $15 million in State Fiscal Relief grants 186 provided by the American Rescue Plan Act for Learn and Work 187 before using the General Fund appropriation provided for that 188 purpose.
