9 General Description:
10 This bill amends an existing program to create the Math and Science Opportunities for
11 Students and Teachers Program.
12 Highlighted Provisions:
13 This bill:
14 < amends an existing program to create the Math and Science Opportunities for
15 Students and Teachers (MOST) Program;
16 < amends the duties and authority of the State Board of Education related to the
17 MOST Program;
18 < repeals requirements on the State Charter School Board related to the MOST
19 Program; and
20 < makes technical and conforming changes.
21 Money Appropriated in this Bill:
22 This bill appropriates in fiscal year 2021:
23 < to the State Board of Education - Minimum School Program - Related to Basic
24 School Programs, as an ongoing appropriation:
25 C from the Education Fund, $900,000; and
26 < to the State Board of Education - MSP Categorical Program Administration, as an
27 ongoing appropriation:
28 C from the Education Fund, $100,000.

39 Be it enacted by the Legislature of the state of Utah:
40 Section 1. Section 53F-2-203 is amended to read:
41 53F-2-203. Reduction of LEA governing board allocation based on insufficient
42 revenues.
43 (1) As used in this section, "Minimum School Program funds" means the total of state
44 and local funds appropriated for the Minimum School Program, excluding:
45 (a) an appropriation for a state guaranteed local levy increment as described in Section
46 53F-2-601; and
47 (b) the appropriation to charter schools to replace local property tax revenues pursuant
48 to Section 53F-2-704.
49 (2) If the Legislature reduces appropriations made to support public schools under this
50 chapter because an Education Fund budget deficit, as defined in Section 63J-1-312, exists, the
51 state board, after consultation with each LEA governing board, shall allocate the reduction
52 among school districts and charter schools in proportion to each school district's or charter
53 school's percentage share of Minimum School Program funds.
54 (3) Except as provided in Subsection (5) and subject to the requirements of Subsection
55 (7), an LEA governing board shall determine which programs are affected by a reduction

56 pursuant to Subsection (2) and the amount each program is reduced.
57 (4) Except as provided in Subsections (5) and (6), the requirement to spend a specified
58 amount in any particular program is waived if reductions are made pursuant to Subsection (2).
59 (5) An LEA governing board may not reduce or reallocate spending of funds distributed
60 to the school district or charter school for the following programs:
61 (a) educator salary adjustments provided in Section 53F-2-405;
62 (b) the Teacher Salary Supplement Program provided in Section 53F-2-504;
63 (c) the extended year for special educators provided in Section 53F-2-310;
64 (d) [USTAR centers] the Math and Science Opportunities for Students and Teachers
65 Program provided in Section 53F-2-505;
66 (e) the School LAND Trust Program described in Sections 53F-2-404 and 53G-7-1206;
67 or
68 (f) a special education program within the basic school program.
69 (6) An LEA governing board may not reallocate spending of funds distributed to the
70 school district or charter school to a reserve account.
71 (7) An LEA governing board that reduces or reallocates funds in accordance with this
72 section shall report all transfers into, or out of, Minimum School Program programs to the state
73 board as part of the school district or charter school's Annual Financial and Program report.
74 Section 2. Section 53F-2-414 is amended to read:
75 53F-2-414. Review of related to basic school programs.
76 (1) No later than November 30, 2018, the Public Education Appropriations
77 Subcommittee shall:
78 (a) review and make recommendations on each program in the related to basic school
79 programs described in Subsection (3);
80 (b) adopt a review schedule going forward for each program described in Subsection
81 (3), placing a program on a schedule to review annually or every four years; and
82 (c) review annually or every four years each program according to the schedule adopted

83 under Subsection (1)(b).
84 (2) For a related to basic school program that is not listed in Subsection (3) and is
85 adopted by the Legislature after January 1, 2018, the Public Education Appropriations
86 Subcommittee shall:
87 (a) review and make recommendations for the program in the program's initial year of
88 implementation;
89 (b) adopt a review schedule going forward for the program, placing the program on a
90 schedule to review annually or every four years; and
91 (c) review annually or every four years the program according to the schedule adopted
92 under Subsection (2)(b).
93 (3) The programs subject to review under Subsection (1) are the following:
94 (a) the state-supported transportation program described in Section 53F-2-403;
95 (b) the weighted pupil unit flexibility allocations described in Section 53F-2-205;
96 (c) the Enhancement for At-Risk Students Program described in Section 53F-2-410;
97 (d) the youth in custody program described in Section 53E-3-503;
98 (e) the adult education program described in Title 53E, Chapter 10, Part 2, Adult
99 Education;
100 (f) the Enhancement for Accelerated Students Program described in Section
101 53F-2-408;
102 (g) the Centennial Scholarship Program described in Section 53F-2-501;
103 (h) the concurrent enrollment program described in Title 53E, Chapter 10, Part 3,
104 Concurrent Enrollment;
105 (i) the Title I Schools Paraeducators Program described in Section 53F-2-411;
106 (j) the School LAND Trust Program described in Section 53F-2-404;
107 (k) the charter school local replacement funding program described in Section
108 53F-2-702;
109 (l) the charter school administration allocations described in Section 53F-2-306;

110 (m) the Early Literacy Program described in Section 53F-2-503;
111 (n) the educator salary adjustments described in Section 53F-2-405;
112 (o) the Teacher Salary Supplement Program described in Section 53F-2-504;
113 (p) the school library books and electronic resources appropriation described in Section
114 53F-2-407;
115 (q) the matching appropriation for school nurses described in Section 53F-2-519;
116 (r) the Dual Language Immersion Program described in Section 53F-2-502;
117 (s) the [Utah Science Technology and Research (USTAR) Initiative Centers] Math and
118 Science Opportunities for Students and Teachers Program described in Section 53F-2-505;
119 (t) the Beverley Taylor Sorenson Elementary Arts Learning Program described in
120 Section 53F-2-506;
121 (u) the early intervention program described in Section 53F-2-507; and
122 (v) the Digital Teaching and Learning Grant Program described in Section 53F-2-510.
123 Section 3. Section 53F-2-505 is amended to read:
124 53F-2-505. Math and Science Opportunities for Students and Teachers Program.
125 (1) As used in this section, "MOST Program" means the Math and Science
126 Opportunities for Students and Teachers Program created in this section.
127 [(1)] (2) (a) The [Utah Science Technology and Research Initiative (USTAR) Centers]
128 Math and Science Opportunities for Students and Teachers Program is created to provide a
129 financial incentive for LEA governing boards to adopt programs in respective [charter schools
130 and school districts] LEAs that result in a more efficient use of human resources and capital
131 facilities.
132 (b) The [potential] intended benefits of the program include:
133 (i) increased opportunities for supporting math and science teachers in their
134 instructional delivery as it pertains to student learning outcomes;
135 [(i)] (ii) increased compensation for math and science teachers by providing
136 opportunities for an expanded contract year which will enhance [school districts' and charter

137 schools'] LEAs' ability to attract and retain talented and highly qualified math and science
138 teachers;
139 [(ii)] (iii) increased capacity of school buildings by using buildings more hours of the
140 day or more days of the year, resulting in reduced capital facilities costs;
141 [(iii)] (iv) decreased class sizes created by expanding the number of instructional
142 opportunities in a year;
143 [(iv)] (v) opportunities for earlier high school graduation;
144 [(v)] (vi) improved student college preparation;
145 [(vi)] (vii) increased opportunities to offer additional remedial and advanced courses in
146 math and science; and
147 [(vii)] (viii) opportunities to coordinate high school and post-secondary math and
148 science education[; and].
149 [(viii) the creation or improvement of science, technology, engineering, and math
150 centers (STEM Centers).]
151 [(2)] (3) From money appropriated for the [USTAR Centers] MOST Program, the state
152 board shall award grants to [charter schools and school districts] LEAs to pay for costs related
153 to the adoption and implementation of the program.
154 [(3)] (4) The state board shall:
155 (a) first, distribute a base amount of funds to each regional service center to support
156 monitoring and compliance and to provide technical assistance to program grantees;
157 [(a)] (b) solicit proposals from [the State Charter School Board and local school
158 boards] an LEA or a regional service center on behalf of an LEA for the use of grant money to
159 facilitate the adoption and implementation of the program; and
160 [(b)] (c) award grants on a competitive basis.
161 [(4) The State Charter School Board shall:]
162 [(a) solicit proposals from charter school governing boards that may be interested in
163 participating in the USTAR Centers Program;]

164 [(b) prioritize and consolidate the proposals into the equivalent of a single school
165 district request; and]
166 [(c) submit the consolidated request to the state board.]
167 (5) In selecting a grant recipient, the state board shall consider:
168 (a) the degree to which [a charter school or school district's] an LEA's proposed
169 adoption and implementation of an extended year for math and science teachers achieves the
170 benefits described in Subsection [(1)] (2);
171 (b) the unique circumstances of different urban, rural, large, small, growing, and
172 declining [charter schools and school districts] LEAs; and
173 (c) providing pilot programs in as many different [school districts and charter schools]
174 LEAs as possible.
175 (6) (a) Except as provided in Subsection (6)(b), [a school district or charter school] an
176 LEA may only use grant money to provide [full year teacher] educator contracts, [part-time
177 teacher] educator contract extensions, educator stipends, or combinations of both, for
178 participating MOST Program math and science teachers.
179 (b) Up to 5% of the grant money may be used to fund math and science field trips,
180 textbooks, and supplies.
181 (7) Participation in the [USTAR Centers] MOST Program [shall be] is:
182 (a) voluntary for an individual teacher; and
183 (b) voluntary for a charter school or school district.
184 Section 4. Appropriation.
185 The following sums of money are appropriated for the fiscal year beginning July 1,
186 2020, and ending June 30, 2021. These are additions to amounts previously appropriated for
187 fiscal year 2021. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
188 Act, the Legislature appropriates the following sums of money from the funds or accounts
189 indicated for the use and support of the government of the state of Utah.

203 Section 5. Coordinating S.B. 93 with S.B. 79 -- Superseding substantive
204 amendments.
205 If this S.B. 93 and S.B. 79, Regional Education Service Agencies, both pass and
206 become law, it is the intent of the Legislature that the Office of Legislative Research and
207 General Counsel shall prepare the Utah Code database for publication by changing all
208 references in Section 53F-2-505 from "regional service center" to "regional education service
209 agency".
