By Powell AN ACT to amend Tennessee Code Annotated, Title 2,
Chapter 1, relative to campaign advertising.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 2-1-116(c), is amended by deleting the subsection and substituting instead:
(1) A county election commission shall issue a notice demanding removal of
signs to a candidate or campaign committee whose signs remain on highway rights-of-
way or other publicly owned property more than three (3) weeks after an election and are not subject to the exception in subsection (b).
(2) A candidate or campaign committee who receives a notice under subdivision
(c)(1) shall remove all signs in violation of this section within ten (10) calendar days of
receiving the notice.
(3) If the signs have not been removed after the ten-day period, a county election commission may levy a civil penalty not to exceed fifty dollars ($50.00) per day,
per parcel of property to the candidate or campaign committee.
SECTION 2. This act takes effect July 1, 2023, the public welfare requiring it.
