SENATE BILL 372
By Campbell AN ACT to amend Tennessee Code Annotated, Title 37,
Chapter 5, relative to persons having an
intellectual disability.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 37-5-103, is amended by adding the following as a new subdivision:
( ) "Intellectual disability" means:
(A) Significantly subaverage general intellectual functioning;
(B) Deficits in adaptive behavior; and
(C) The intellectual disability must have manifested during the developmental period, or by eighteen (18) years of age.
SECTION 2. Tennessee Code Annotated, Title 37, Chapter 5, Part 2, is amended by
adding the following as a new section:
The department shall determine whether any child who is placed in a youth development center has an intellectual disability.
SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
