For purposes of interpreting the meaning of the word "sex" throughout present law, except in statutes where the context otherwise requires, this bill defines "sex" as a person's immutable biological sex as determined by anatomy and genetics existing at the time of birth and evidence of a person's biological sex. For purposes of this definition, "evidence of a person's biological sex" includes, but is not limited to, a government-issued identification document that accurately reflects a person's sex listed on the person's original birth certificate.
ON MARCH 13, 2023, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1440, AS AMENDED.
AMENDMENT #1 clarifies that "sex" is defined for the code as provided in this bill, unless the context otherwise requires.
