SENATE BILL 1647
By Walley AN ACT to amend Chapter 142 of the Private Acts of 1953; as amended by Chapter 143 of the Private Acts of 1965;
Chapter 122 of the Private Acts of 1981; Chapter 57 of the Private Acts of 1983; Chapter 12 of the Private Acts of 1985; Chapter 104 of the Private Acts of 1987;
Chapter 103 of the Private Acts of 1987; Chapter 178 of the Private Acts of 1988; Chapter 68 of the Private Acts of 1995; Chapter 186 of the Private Acts of 1996;
Chapter 35 of the Private Acts of 2005 and Chapter 11 of the Private Acts of 2019; and any other acts amendatory thereto, relative to the charter of the City of Bolivar.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Section 2.08 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 143 of the Private Acts of 1965, Chapter 122 of the Private Acts of 1981, Chapter 57 of the Private Acts of 1983, Chapter 12 of the Private Acts of 1985, Chapter 104 of the Private Acts of 1987, Chapter 103 of the Private Acts of 1987, Chapter 178 of the Private Acts of 1988,
Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, Chapter 35 of the Private Acts of 2005, and Chapter 11 of the Private Acts of 2019, and any other acts amendatory thereto, is amended by deleting the section and substituting instead the following:
Section 2.08. City Recorder. The Mayor shall appoint a city recorder who shall serve at the pleasure of the Mayor. The recorder shall perform all administrative duties for the mayor and councilmen as imposed upon the recorder by ordinances and resolutions. The recorder shall perform all administrative duties that are not assigned by
the charter or code to another corporate officer or employee. The recorder shall be
responsible for keeping and preserving the city seal and all records of the council,
attending meetings of the council, and keeping minutes of its proceedings, including each motion considered and all resolutions and ordinances. The recorder shall maintain custody of the city public records and of all contracts, deeds, and certificates relative to
the title of any corporate property, all bonds, papers, and documents of value as are not SB1647

required to be deposited with any other person. The recorder shall countersign all contracts, bonds, and other documents requiring dual signatures.
SECTION 2. Section 2.10 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 143 of the Private Acts of 1965, Chapter 122 of the Private Acts of 1981, Chapter 57 of the Private Acts of 1983, Chapter 12 of the Private Acts of 1985, Chapter 104 of the Private Acts of 1987, Chapter 103 of the Private Acts of 1987, Chapter 178 of the Private Acts of 1988,
Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, Chapter 35 of the Private Acts of 2005, and Chapter 11 of the Private Acts of 2019, and any other acts amendatory thereto, is amended by deleting the word "administrator" wherever it appears and substituting instead the word "recorder".
SECTION 3. Section 2.12 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 143 of the Private Acts of 1965, Chapter 122 of the Private Acts of 1981, Chapter 57 of the Private Acts of 1983, Chapter 12 of the Private Acts of 1985, Chapter 104 of the Private Acts of 1987, Chapter 103 of the Private Acts of 1987, Chapter 178 of the Private Acts of 1988,
Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, Chapter 35 of the Private Acts of 2005, and Chapter 11 of the Private Acts of 2019, and any other acts amendatory thereto, is amended by deleting the word "administrator" and substituting instead the word "recorder".
SECTION 4. Section 3.07 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 12 of the Private Acts of 1985, Chapter 103 of the Private Acts of 1987, Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, and Chapter 35 of the Private Acts of 2005, and any other acts amendatory thereto, is amended by deleting the word
"Administrator" and substituting instead the word "Recorder".
SECTION 5. Section 3.08 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 12 of the Private Acts of 1985, Chapter 103 of the Private Acts of 1987, Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, and Chapter 35 of the Private

Acts of 2005, and any other acts amendatory thereto, is amended by deleting the word
"administrator" and substituting instead the word "recorder".
SECTION 6. Section 3.09 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 12 of the Private Acts of 1985, Chapter 103 of the Private Acts of 1987, Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, and Chapter 35 of the Private Acts of 2005, and any other acts amendatory thereto, is amended by deleting the word
"administrator" and substituting instead "recorder" and by deleting the word "administrator's"
and substituting instead the word "recorder's".
SECTION 7. Section 4.14 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 12 of the Private Acts of 1985, Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, and Chapter 11 of the Private Acts of 2019, and any other acts amendatory thereto, is amended by deleting the section and substituting instead the following:
Section 4.14. Disbursements by Checks. That all disbursements from city funds shall be made by checks signed by two of the three officers - mayor, city recorder, or financial officer.
SECTION 8. Section 2.03 of Chapter 142 of the Private Acts of 1953, as amended by
Chapter 143 of the Private Acts of 1965, Chapter 122 of the Private Acts of 1981, Chapter 57 of the Private Acts of 1983, Chapter 12 of the Private Acts of 1985, Chapter 104 of the Private Acts of 1987, Chapter 103 of the Private Acts of 1987, Chapter 178 of the Private Acts of 1988,
Chapter 68 of the Private Acts of 1995, Chapter 186 of the Private Acts of 1996, Chapter 35 of the Private Acts of 2005, and Chapter 11 of the Private Acts of 2019, and any other acts amendatory thereto, is amended by deleting the sentence:
The salaries of the mayor and councilmembers shall be paid in monthly installments from the city treasury.
and substituting instead:
The salary of the mayor shall be paid in the same manner as city employees, and the salaries of the councilmembers shall be paid monthly.

SECTION 9. This act shall have no effect unless it is approved by a two-thirds (2/3) vote of the legislative body of the City of Bolivar. Its approval or nonapproval shall be proclaimed by
the presiding officer of the legislative body and certified to the secretary of state.
SECTION 10. For the purpose of approving or rejecting the provisions of this act, it shall be effective upon becoming a law, the public welfare requiring it. For all other purposes, it shall become effective as provided in Section 9.
