This bill prohibits private employers and state and local governmental entities from:
(1) Requiring an employee to receive an immunization or vaccination for COVID-19 against the will of the employee as a condition of maintaining employment; or
(2) Taking adverse action against an employee who refuses to receive an immunization or vaccination for COVID-19 against the will of the employee.
Under present law, the Occupational Safety and Health Act provides that it does not authorize or require medical examination, immunization or treatment for those who object to the medical examination, immunization or treatment on religious grounds, except where the medical examination, immunization or treatment is necessary for the protection of the health or safety of others. This bill removes the provision for requiring a medical examination, immunization, or treatment when such is necessary for the protection of the health or safety of others.
