HOUSE RESOLUTION 3

A RESOLUTION relative to the commissioner of the Department of Education.
WHEREAS, public confidence in the integrity, efficiency, and smooth operation of the Department of Education is of paramount importance to the citizens of the State of Tennessee;
and WHEREAS, Tennessee Code Annotated, Section 4-3-802, provides that the chief executive officer of the department of education shall be the commissioner of education who shall be appointed by the governor; and WHEREAS, Tennessee Code Annotated, Section 49-1-102(a), states that the "system of
public education in this state shall be governed in accordance with laws enacted by the general assembly and under policies, standards, and guidelines adopted by the state board of education that are necessary for the proper operation of public education in kindergarten through grade twelve (K-12). The policies, standards and guidelines shall be formulated by the state board of
education, with such assistance from the commissioner of education as the state board may request."; and WHEREAS, Tennessee Code Annotated, Section 49-1-102(b), states that "The commissioner shall perform such duties as are assigned to the commissioner by law and is
responsible for the administration, implementation, supervision and enforcement of the policies,
standards and guidelines of the state board of education."; now, therefore,
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE ONE HUNDRED
TWELFTH GENERAL ASSEMBLY OF THE STATE OF TENNESSEE, THE SENATE

CONCURRING, that the General Assembly declares a position of "No Confidence" in Penny Schwinn, commissioner of the Department of Education.
BE IT FURTHER RESOLVED, that the General Assembly hereby urges the Governor to
replace Penny Schwinn as the commissioner of the Department of Education with someone who is able to fulfill the responsibilities of the office.
BE IT FURTHER RESOLVED, that a certified copy of this resolution be transmitted to
the Governor of the State of Tennessee.
