House Bill 1009

An Act to modify the observation of time in South Dakota.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 1-5 be amended with a NEW SECTION:

The official standard time of the State of South Dakota is the time established by 15 U.S.C.   261 in both the central and mountain time zones.

During the period commencing at two a.m. on the first Sunday of November of each year and ending at two a.m. on the second Sunday of March each year, the portion of the state using central standard time shall observe eastern standard time as the official standard time, and the portion of the state using mountain standard time shall observe central standard time as the official standard time.

If the United States Congress amends 15 U.S.C.   260(a) to authorize states to observe permanent daylight saving time, the official standard time of the State of South Dakota is central daylight time in the portion of the state using central time, and mountain daylight time in the portion of the state using mountain time.
