House Bill 1213

An Act to clarify the Corrections Commission's ability to obtain criminal justice information.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That   1-15-1.14 be AMENDED:

1-15-1.14. The Corrections Commission established in    1-15-1.13 shall undertake a continuing study of criminal justice issues in South Dakota. The study may include a review of current felonies, felony sentences, sentencing options, practices, programs, trends, and initiatives. For this purpose, the commission may require any state or local criminal justice agency, as defined in    23-5A-1, to submit any criminal justice information that:

(1) Is currently collected and readily reportable by the agency at the time of the request; or

(2) Is necessary to achieve the commission's purpose, as determined by a majority of the full commission.

This section does not authorize the commission to require state or local criminal justice agencies to collect or maintain any data that is not necessary to achieve the commission's purpose.

The commission shall annually report on its activities to the Legislature, Governor, and Chief Justice of the Supreme Court.
