An Act to prohibit certain activities related to a person's COVID-19 vaccination status and provide a penalty therefor.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 34-22 be amended with a NEW SECTION:

Nothing in this chapter authorizes the state, any political subdivision of this state, or any private-sector employer to:

(1) Issue vaccine passports, vaccine passes, or any standardized document for the purpose of verifying a person's COVID-19 vaccination status to a third party;

(2) Publish or share any person's COVID-19 vaccination record or similar health information; or

(3) Require the presentation of any documentation certifying COVID-19 vaccination or post-transmission recovery to gain access or entry, or to obtain or retain employment.

No person may be required to present documentation certifying COVID-19 vaccination or post-transmission recovery in order to gain access, entry, or service in this state, or to be permitted to participate in any for profit or not-for profit event occurring in this state.

Any person who violates this section is subject to a Class 1 misdemeanor and a civil fine in the amount of $10,000 for each violation. The circuit court shall forward all fines collected under this section to the state treasurer for deposit in the general fund.

Nothing in this section prohibits the use of COVID-19 screening protocols to protect the public health.
