Senate Bill 69

An Act to provide for an electronic system to update voter registration information.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 12-4 be amended with a NEW SECTION:

A person currently registered to vote with voter information contained within the master registration file under    12-4-9, who has a valid South Dakota driver license or South Dakota nondriver identification card, may submit changes to their voter registration form electronically through an electronic voter registration interface maintained by the Office of the Secretary of State, as provided in section 2 of this Act. For the purpose of accurate voter registration records, an applicant may submit changes of last name, residence address, mailing address, telephone number, email address, previous voter registration information, party affiliation, and willingness to serve as an election worker.

Any applicant updating voter registration information under this section must make a sworn written statement declaring and affirming, under the penalty of perjury, that the applicant is currently registered to vote with voter information contained within the master registration file under    12-4-9, and that the applicant consents to providing the requested information under this section. This statement may be made electronically as part of the process of utilizing the electronic voter registration interface.

Section 2. That chapter 12-4 be amended with a NEW SECTION:

The electronic voter registration interface must:

(1) Authenticate the identity of any applicant under a process developed by the secretary of state that includes verifying the following information with the driver license database maintained by the Department of Public Safety:

(a) The applicant   s valid South Dakota driver license or South Dakota nondriver identification card number;

(b) The last five digits of the applicant   s social security number;

(c) The applicant   s full name as printed on the applicant   s South Dakota driver license or South Dakota nondriver identification card; and

(d) The applicant   s date of birth;

(2) Obtain an electronic copy of the applicant   s signature from the applicant   s South Dakota driver license or South Dakota nondriver identification card from the driver license database maintained by the department. For voter registration purposes, the applicant shall be required to assent to the use of the applicant   s signature from his or her South Dakota driver license or South Dakota nondriver identification card; and

(3) Transmit any completed and verified voter registration updates to the master voter registration file.

Section 3. This Act is effective January 1, 2023.
