An Act to make an appropriation to fund certain small meat processor grants and to declare an emergency.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. There is hereby appropriated from the general fund the sum of $1 to the Department of Agriculture, for purposes of providing grants to small meat processors in South Dakota.

Section 2. For the purposes of this Act, a small meat processor is any official establishment, slaughtering establishment, meat processing establishment, or custom exempt plant, as defined in   39-5-6, that is required to be licensed under   39-5-11.1, or that is inspected by the United States Department of Agriculture Food Safety and Inspection Service.

Section 3. The funds appropriated in section 1 of this Act may be expended solely on grants used to reimburse up to fifty percent of eligible invoices for equipment and facility enhancements, according to terms and conditions established by the secretary of the Department of Agriculture.

Section 4. The secretary of the Department of Agriculture shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized by this Act.

Section 5. Any amounts appropriated in this Act not lawfully expended or obligated shall revert in accordance with the procedures prescribed in chapter 4-8.

Section 6. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
